From and after the effective date of this article, the following regulations shall control the preparation of refuse and garbage proposed to be collected by employees of the Township of Brick:
A. 
Garbage. Garbage shall only be placed in the containers provided by the Township for that purpose. Each real property owner within the Township that is presently having their solid waste collected by the Township shall receive one ninety-five-gallon container. Each such owner may purchase from the Township one additional container for garbage collection by the Township. Each container shall be placed for collection just inside the curbline and at the place designated by the Township for collection, which shall be free from obstruction to the collection system operating as designed. In those parts of Brick wherein the automated solid waste collection system is not operational, garbage may be left in watertight plastic or metal containers whose volume does not exceed the total volume in two ninety-five-gallon containers otherwise provided by the Township. All other provisions of this article shall apply also to such properties. The garbage shall be thoroughly and completely drained of all liquids and placed in the containers hereinbefore set forth. Grass, weeds and similar growths, excluding leaves, may be placed in this container so that they may be readily emptied into the municipal collection vehicle. The Township shall collect no more than two containers from any separate parcel of real property.
B. 
Vegetation. Tree trimmings, hedge clippings and similar materials, including leaves, except as hereinafter provided, shall be cut to a length not to exceed four feet and securely tied in bundles not more than two feet thick. All grass, leaves, branches or yard rakings shall be placed in suitable containers and shall not be placed loose or in piles in the sidewalks, gutters or streets where the same may be dispersed by wind, forces of nature, passersby or traffic, except during the months of October and November and from April 15 through May 15 of each year. Leaves or other materials specified within this article shall not be burned in any street, alley or highway.
C. 
Recycling. Recycling materials shall be placed only in the blue containers provided by the Township for that purpose. All recycling materials shall be put into the blue containers and placed at the curb. Recycling material shall not be tied, bundled or bagged. Public works shall pick up recycling every other week. The Township follows the Ocean County Department of Solid Waste Recycling Guidelines, which include the following items as recyclable:
(1) 
Plastic bottles with a neck smaller than the base of the container, such as beverage containers, shampoo/conditioner bottles, laundry/dish detergent containers, milk jugs and salad dressing bottles.
(2) 
Cans, including aluminum cans, steel, tin and empty aerosol cans.
(3) 
Glass bottles, jars and glass containers of all shapes, sizes and colors. Glass bottles and containers shall be emptied and rinsed, with all caps, lids and pumps removed and put into the trash containers.
(4) 
Corrugated cardboard boxes.
(5) 
Mixed paper: magazines, catalogs, paperback books, hardcover books with covers removed, junk mail (including envelopes), office paper, computer paper, school papers, newspapers plus inserts, brown paper bags, construction paper, wrapping paper and greeting cards.
D. 
Bulk pick-up. Public Works is not responsible for the removal of items due to a change of occupancy (rental, eviction or sale of house). Bulk items left at the curb as a result of a change of occupancy will be considered a "move out" and will be referred to Code Enforcement for issuance of violations notices. For non-move-out situations, the following bulk items may be picked up by Public Works:
(1) 
Furniture, including sofas (sofa beds must have metal frame removed), outdoor furniture, household furniture.
(2) 
Mattresses.
(3) 
Rugs (rolled and tied in four-foot sections).
(4) 
Padding (bagged or rolled and tied).
(5) 
Swing sets (dismantled and concrete removed).
(6) 
Stockade fence (broken down into four-foot sections with nails removed or banged in).
(7) 
Play houses.
(8) 
Sliding glass doors (metal removed).
(9) 
Metal frames from sofa bed.
(10) 
Sliding glass door frames.
(11) 
Refrigerators (doors and freon removed).
(12) 
Lawnmowers (empty of gas and oil).
(13) 
Metal sheds (dismantled and bound in small piles).
(14) 
Washer & dryer (doors removed).
(15) 
Ovens (doors removed).
(16) 
Microwaves.
(17) 
Air conditioners (freon removed).
E. 
Refuse mentioned in Subsections A through D above shall not be mixed with or placed in the same container referred to Subsection A above. Neither shall garbage that is to be placed in the containers referred to in Subsection A be mixed with or placed with any other refuse referred to in Subsections A through D of this section.
F. 
No dangerous material, highly volatile or explosive matter, either in liquid, gaseous or solid form, shall be placed or set out for collection either by itself or in connection with any other garbage, trash, waste, rubbish, ashes or other refuse material. No person shall place in any receptacle any garbage, refuse or any material which could be injurious to the employees of the municipality and/or those persons charged with the collection of such material.
G. 
No construction materials shall be placed or set out for collection either by itself or in connection with any other garbage, trash, waste, rubbish, ashes or other refuse material.
A. 
If any container of garbage is upset or overturned other than by Township employees engaged in garbage and refuse collection, the property owner, tenant or other person placing garbage for municipal collection shall promptly clean up such spilled garbage and restore it to the containers provided by the Township.
B. 
If any container or garbage is upset or overturned by a Township employee, he shall immediately collect such garbage and dispose of the same in the municipal garbage truck.
If any Township employee observes the noncompliance with any of the regulations in §§ 390-43 and 390-44 of this article, he shall immediately notify the tenant or landowner of the noncompliance and reason for not making the collection. Such notice may be given personally or by a written statement thereof left on the premises. Each instance of noncollection shall be daily reported to the appropriate supervisor by the person in charge of the particular municipal truck not making such collection.

No person shall place or allow any garbage, refuse or other item to be placed for collection to be so placed any earlier than 6:00 p.m. of the day preceding the date on which such garbage, refuse or other item is to be collected by the Township. Any empty container shall be removed by 8:00 a.m. on the morning following the day of collection to a location which is at least 20 feet from the edge of the pavement or within three feet of the principal dwelling. If any Brick resident wishes to leave any additional or other form of garbage not hereinabove specified, such person shall first call the Department of Public Works and request such garbage to be removed prior to placing it at curbside. The Director of Public Works shall determine whether to remove from the curb such garbage in light of the time, effort and expense of removing and disposing of such garbage. In the event the director of Public Works determines that it is unduly burdensome for the Township to remove such garbage, then the person responsible for the property on which the garbage is located shall be responsible for such removal.

Each newly constructed residential property within the Township of Brick shall be issued a new garbage container, in a size to be determined by the Director of Public Works, upon receipt of a certificate of occupancy. The fee for the purchase of an initial garbage container shall be included in the fee paid by the developer for the issuance of a certificate of occupancy pursuant the Code of Fees referred to in § 145-3.

Any real property owner who has purchased an additional garbage container may request a refund upon the return of the container. The refund may be issued upon the approval of the Township Business Administrator or Chief Financial Officer upon verification that the container has been returned in satisfactory condition.

A. 
A fee of $75 shall be charged to any real property owner purchasing an additional ninety-five-gallon garbage container for garbage collection by the Township.
B. 
A fee of $65 shall be charged to any real property owner purchasing an additional sixty-five-gallon garbage container for garbage collection by the Township.
C. 
A fee of $65 shall be charged to any real property owner purchasing an additional thirty-five-gallon garbage container for garbage collection by the Township.
The Township shall not be obligated to collect any garbage or other materials left in a manner not in full compliance with the regulations provided herein nor garbage that is not left in the containers described hereinabove and provided by the Township. When any of the items named in or referred to in § 390-43 hereof are placed at or just inside the curbline, it shall be assumed that the same are so placed for municipal garbage and refuse collection and disposal.
No municipal employee shall collect any of the items referred to in § 390-43 hereof unless and until such items are prepared for municipal collection and disposal, as referred to and as directed in § 390-43 hereof, unless otherwise directed by the Mayor, Business Administrator, Director of Public Works or a supervisor in the Department of Public Works.
The following regulations shall apply to all real property owners wherein such real property is used for other than exclusively single-family residential purposes. For the purposes of this provision, such properties shall be referred to as "commercial."
A. 
The Township of Brick shall collect garbage only from those commercial properties that had previously received such service from the Township of Brick and as are shown on a list filed with the Township Clerk. The containers to be utilized shall be left with only the property owners or such person as may be designated in writing by the property owner.
B. 
The Township shall collect no more than two containers from each commercial landowner.
C. 
All commercial properties shall be subject to the same regulations provided for in this chapter with respect to recyclable materials and their disposition.
D. 
Noncollection criteria.
(1) 
In the event that any commercial property is the subject of any of the following, then the Township shall no longer collect containers for such property, and such property shall be stricken from the list kept by the Township Clerk and referred to hereinabove:
(a) 
Said property receives any development approval for a change, alteration or addition to the site or any structure contained therein from the Planning Board or Zoning Board of Adjustment of the Township of Brick.
(b) 
The property is conveyed for value to another after the effective date of this article.
(c) 
The use of said property is changed.
(d) 
The property owner relinquishes its opportunity to receive municipal garbage collection by doing so in writing in a form prescribed by the Township and submitted to the Township Clerk.
(e) 
If pursuant to this chapter the Township terminates or suspends the collection of garbage of any particular property.
(2) 
If any of the events specified in Subsection D(1) occur, the property owner shall return any containers to the Township and upon such return shall receive a refund for any container purchased.
The Township may upon 10 days' written notice to any property owner terminate or suspend for a specified period of time the collection of garbage from any property as a result of the owner, tenant or occupant of such property violating any provision of this article. The violations shall be specified in such notice giving the nature of the violation, the section violated and the date on which such violation occurred.

A. 
The Township of Brick maintains a drop-off center for the convenience of Township residents for the disposition of various waste materials generated by their personal use. Said drop-off center is for the use of residents of Brick Township for disposition of waste materials generated by their personal use only. Waste materials accepted at the drop-off center are as follows: solid waste, bulk items, metal, water-based paint, clothes, batteries, electronics and any other items designated by the rules and regulations promulgated by the Township Council, Director of Public Works and/or the Township Engineer.
B. 
Waste materials as set forth in this article and generated from the personal use of residents must be brought to the drop-off center during normal operating hours. It shall be a violation of this article for any resident to drop of waste materials at the Township drop-off center at any time other than normal operating hours as posted at the drop-off center.
C. 
Specially marked containers and/or areas shall be maintained at the drop-off center for waste materials as set forth by this article. All waste materials must be placed in the proper container and/or area, which shall be plainly marked. It shall be a violation of this article for any resident to place waste materials anywhere either inside or outside the drop-off center except the designated areas, as posted at the center.
D. 
Residents shall be limited to a total of 12 drop-offs in a calendar year (excluding drop-offs of recyclables and/or household trash).
E. 
It shall be a violation of this article for any resident, individual or business entity to drop off construction materials at the Brick Township drop-off center.
Any person, firm, corporation or association violating the terms of this article, whether as principal, agent or employee of another, shall, upon conviction in the Municipal Court of the Township of Brick in the County of Ocean, be subject to the penalties as provided in Chapter 1, § 1-15, General penalty.
