It shall be unlawful for any minor under the age of 17 years to loiter, idle, wander, stroll or play in or upon the public streets, highways, roads, alleys, parks, public buildings, places of amusement and entertainment, vacant lots or other unsupervised places, between the hours of 10:30 p.m. and 6:00 a.m. of the following day; provided, however, that the provisions of this section do not apply to a minor accompanied by his or her parent, guardian or other adult person having the care and custody of the minor or where the minor is upon an emergency errand or legitimate business directed by his or her parent, guardian or other adult person having the care and custody of the minor.
It shall be unlawful for the parent, guardian or other adult person having the care and custody of a minor under the age of 17 years to knowingly permit such minor to loiter, idle, wander, stroll or play in or upon the public grounds, public places and public buildings, places of amusement and entertainment, vacant lots or other unsupervised places, between the hours of 10:30 p.m. and 6:00 a.m. of the following day; provided, however, that the provisions of this section do not apply when a minor is accompanied by his or her parent or guardian or other adult person having the care and custody of the minor or when the minor is upon an emergency errand or legitimate business directed by his or her parent, guardian or other adult person having the care and custody of the minor.
A. 
Any minor convicted of violating the provisions of this chapter shall be fined not more than $75.

B. 
Any parent, guardian or other adult having the care and custody of a minor convicted of violating the provisions of this chapter shall be fined more than $75.

C. 
Whenever it shall appear that the Family Court of the State of Delaware has jurisdiction over any minor charged with violating any of the provisions of this chapter, the officer or officers having such minor in charge are hereby authorized to deliver such minor or minors to said Family Court for such action by said Court as said Court shall deem proper.
This chapter shall be suspended upon recommendation of the Public Safety Committee and approval of Mayor and Council.
