The Village of Briarcliff Manor discourages in all instances and prohibits in most instances private sewage disposal systems; however, in those limited instances where conditions are such that buildings cannot be connected to a public sanitary sewer because of nonavailability, under provisions of § 168-5, the building sewer may be connected to a private sewage disposal system complying with the provisions of this article, the provisions of Article XII of the Public Health Law of the State of New York and the Sanitary Code, Westchester County Department of Health, provided that such temporary private sewage disposal system may be installed only when the prior written consent of the Village Board of Trustees or its duly authorized representative has been obtained.
All persons wishing to construct a private sewage disposal system must, after having obtained the consent of the Village, make application to and secure a written permit from the Westchester County Health Department under the provisions of Article VII of the Sanitary Code, Westchester County Department of Health.
A permit for the operation of a private sewage disposal system shall not become effective until a certificate of construction and plans of the completed work are filed by a professional engineer licensed in the State of New York, and the installation is completed to the satisfaction of and has been approved by the Westchester County Health Department.
The type, capacities, location and layout of a private sewage disposal system shall comply with all the recommendations of the Department of Public Health of the State of New York and the Sanitary Code, Westchester County Department of Health, Article VII.
At such time as a public sewer becomes available to a property served by a private sewage disposal system, as provided in § 168-5, a direct connection shall be made to the public sewer in compliance with this chapter, and any septic tanks, cesspools and similar private sewage disposal facilities shall be abandoned and filled with suitable material.
The owner shall operate and maintain the private sewage disposal facilities in a sanitary manner at all times, at no expense to the Village.
No statement contained in this article shall be construed to interfere with any additional requirements that may be imposed by the Department of Health of the State of New York, or the Westchester County Department of Health.
When a public sewer becomes available, the building sewer shall be connected to said sewer within three years and the private sewage disposal system shall be cleaned of sludge and filled with clean bank-run gravel or dirt.
