Any individual applying for representation by a Municipal Public Defender or court-approved counsel shall be required to pay a fee of not more than $200, which fee or any part of it may be waived by the court only upon a clear and convincing showing that the fee or any part of it represents an unreasonable burden on the person.
The Municipal Court may permit a person to pay the application fee over a specific period of time not to exceed four months. Funds collected pursuant to § 55-9 shall be deposited in a dedicated fund administered by the Chief Financial Officer of the municipality. Such funds shall be used exclusively to meet the costs incurred in providing the service of the Municipal Public Defender Program including salary, discovery costs, copying costs and expert and lay investigation and testimony.
