A.
Except as otherwise provided herein, no real property
in the village and no real property outside the village as to which the village's
approval is required for subdivision may be divided into more than one lot,
nor may any lot line be changed, relocated or moved, except with the prior
approval of the Board of Trustees. Review and approval of an application for
any such subdivision shall be heard and determined in accordance with Village
Law § 7-728, except as otherwise provided herein. The Village Board
of Trustees shall constitute the Planning Board of the village for such purposes.
B.
Where a proposed partition of land is eligible, pursuant to Real Property Law § 334-a, for waiver of subdivision approval requirements, and where the Board of Trustees grants its consent to such waiver, one or more lots may be partitioned without first having to obtain subdivision approval pursuant to Subsection A of this section.
C.
Village Law § 7-728, Subdivision 8, is hereby
repealed in its application to the Village of Hewlett Neck.

A.
Stormwater pollution prevention plan required. A stormwater pollution prevention plan (SWPPP) consistent with the requirements of Chapter 179, entitled "Stormwater Management and Erosion and Sediment Control," shall be required for subdivision approval. The SWPPP shall meet the performance and design criteria and standards in Chapter 179, Article II. The approved subdivision plat shall be consistent with the provisions of Chapter 179.
