This article shall be known as the "Usage of Bows, Firearms and Trapping on Posted Property Local Law of the Town of North Salem" for the protection of the general health, welfare and safety of the general public.
The use of any bow, firearm or trap within the bounds of posted property in the Town of North Salem shall be unlawful unless:
A. 
The private property owner or immediate family so acts on his own property in a fashion which does not permit the prohibited activity to cross onto the lands of another owner.
B. 
An individual so acts with the permission (as described under Registration, § 91-4) of the property owner or his authorized representative in a fashion which does not permit the prohibited activities herein to cross onto the lands of another owner.
Exceptions shall be as follows:
A. 
The discharge of any firearm within the bounds of the Town of North Salem, by a law enforcement official acting in the proper course of his or her duties.
A. 
An individual acting with the permission of a property owner or the landowner's authorized representative shall register on an annual basis at the office of the Town Clerk.
B. 
A club or association which represents individuals acting with permission of a property owner or the landowner's authorized representative shall register each individual on an annual basis at the office of the Town Clerk.
C. 
Applicants for registration shall complete and tender a fully executed Landowner Permission Record (Attachment A).[1]

D. 
Attachment A shall signify permission of the landowner by:
(1) 
Personal signature or signature of landowner's authorized representative.
(2) 
Verification of verbal permission of landowner or landowner's authorized representative by the office of the Town Clerk. Upon verification the Town Seal will be affixed to signify permission.
E. 
An individual claiming to be acting pursuant to the permission of the owner or landowner's authorized representative of the land he is upon shall have upon his person the fully executed Permission Card portion of Attachment A[2] and shall exhibit the same to any law enforcement officer upon request.

Any person who has not been previously convicted under this article during the previous 10 years found violating any of the provisions of this article shall be guilty of a violation and, upon conviction thereof, shall be punished by a fine not to exceed the sum of $250 and/or imprisonment for no more than 10 days for the first offense. Any person found violating any provisions of this article who shall have been previously found guilty of violating this article within a period of 10 years after the last prior conviction shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine not exceeding $500 and/or imprisonment for no more than 60 days for such second offense.
This article shall become effective on September 30, 1999, upon filing in the office of the Secretary of State, State of New York.
