As used in this article, the following words and phrases shall have the stated meanings:
HANDICAPPED
A disadvantage that makes achievement unusually difficult.
HIGHWAY
The entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel.
PARK or PARKING
The standing of a vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers.
SEVERELY DISABLED PERSON
A person who has limited or no use of one or both lower limbs or has a neuromuscular dysfunction which severely limits mobility or has a physical or mental impairment or condition, certified by a physician, of such nature as to prevent such person from getting around without great difficulty, or who is blind.
STAND or STANDING
The stopping of a vehicle, whether occupied or not, otherwise than temporarily, for the purpose of and while actually engaged in receiving or discharging passengers.
STOP or STOPPING
When prohibited, any halting, even momentarily, of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic control sign or signal.
A. 
The parking, standing or stopping of motor vehicles upon the public or private streets, roads and highways of the Town of Malta shall be regulated and restricted as the Town Board shall provide by resolution.
(1) 
Upon the adoption of any resolution regulating or restricting such parking, the Town Board shall cause to be erected in the area or areas where such regulations or restrictions are imposed appropriate signs indicating that such regulations or restrictions shall subject the violator to the penalties hereinafter provided.
(2) 
All signs erected prior to the effective date of this chapter indicating a regulation or restriction on parking are hereby continued in full force and effect and shall subject the violator to the penalties hereinafter provided.
B. 
When stopping is prohibited by any resolution adopted pursuant to this article, no person shall stop, stand or park a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer, peace officer or traffic control sign or signal.
C. 
When standing is prohibited by any resolution adopted pursuant to this article, no person shall stand or park a vehicle, whether occupied or not, but may stop temporarily for the purpose of and while actually engaged in receiving or discharging passengers.
D. 
When parking is prohibited by any resolution adopted pursuant to this article, no person shall park a vehicle, whether occupied or not, but may stop or stand temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers.
E. 
When official signs have been posted prohibiting, restricting or limiting the stopping, standing or parking of a vehicle on any highway, no person shall stop, stand or park any vehicle in violation of the restrictions stated on such signs.
F. 
No person shall park, leave, store, or cause to remain on any portion of the roads, streets, highways, public ways, or rights-of-way of the Town of Malta, for a period in excess of 24 hours any of the following: a trailer, a boat, a camper, a recreational vehicle, an unregistered truck or automobile, a snowmobile, an all-terrain vehicle, or any vehicle designed to be towed by a truck or automobile. No person shall park a motor vehicle within four feet of a road, street, highway, public way or Town right-of-way from November 1 to March 31, or at any time when there is more than one inch of snow on the ground

It shall be a violation for any person to stop, stand or park a vehicle in any area designated as a place for handicapped parking unless such vehicle is being used for the transportation of a severely disabled or handicapped person.
Any peace officer or police officer having jurisdiction within the Town of Malta who shall encounter any vehicle in violation of this article may remove said vehicle to a place designated by the Saratoga County Sheriff or the New York State Police. The owner or the duly designated agent of the owner of such vehicle may redeem the same upon payment of expenses and charges necessarily and actually incurred by the removal of said vehicle.
