The following article relating to the nine-member Sewer and Water Commission (the "Commission"), established by § C-1102 of the Charter for the Town of Colchester, is hereby adopted by the Town of Colchester.[1]

A. 
No less than 50% of the persons who serve on the Commission shall be (i) residents of the Sewer and Water District (the "District") and/or (ii) owners of real property in the District. If any member of the Commission changes his or her District status by virtue of a move out of the District, or by selling or otherwise disposing of real property in the District, and such move, sale, or disposition causes District representation on the Commission to be below 50% of the members, then, in such event, such member shall be allowed to finish out his/her term so long as such member is otherwise qualified. The Board of Selectmen shall name replacements for vacant positions on the Commission in accordance with the residency and ownership requirements of this ordinance.
B. 
Notwithstanding anything in this section to the contrary, in filling a vacancy, if the Board of Selectmen determines that there are no residents of or owners of real property in the District who are qualified and willing to serve on the Commission, the Board of Selectmen may appoint a person who does not reside or own real property in the District even though the District representation on the Commission may be below 50%.
On July 1, 1995, the Board of Selectmen shall appoint three members of the Commission to serve one-year terms of office, three members to serve two-year terms of office and three members to serve three-year terms of office. Thereafter, as terms of office expire, the Board of Selectmen shall appoint members of the Commission in place of members whose terms expire, each for a three-year term of office.
