A. 
Any offense against any provision of this Part 3 shall be deemed a violation. Each and every day of such violation shall be deemed a separate and distinct violation of this Part 3. Every conviction of a violation of any provision of this Part 3 shall be punished by fine of not more than $250 or by imprisonment for a term not exceeding 15 days, or both. For the purpose of conferring jurisdiction upon courts and judicial officers generally, violations of this Part 3 shall be deemed misdemeanors, and for such purpose only, all provisions of law relating to misdemeanors shall apply to such violation.

B. 
In addition, a penalty may be assessed, not exceeding $500 for each violation, to be sued for recovery in a civil action brought in the name and for the benefit of the Town of Queensbury, New York. This penalty is in addition to the liability of a violator for damage to equipment of the sewer district from improper discharge under the Part 3.
C. 
The Town Sewer Inspector and the Plumbing Inspector, and such other Town officers as the Town Board shall direct, are authorized to initiate whatever appropriate judicial proceedings are deemed necessary to prohibit violations of this Part 3.
D. 
Any person who knowingly makes any false statements, representation, record, report, plan or other documentation filed with the municipality or who falsifies, tampers with or knowingly renders inaccurate any monitoring device or method required under this Part 3 shall be punishable in accordance with § 175.30 of the Penal Law.
The Town is also authorized to issue an order to cease and desist and direct those persons not complying with such prohibitions, limits, requirements or provisions of this Part 3 or the wastewater discharge permit to:
A. 
Comply forthwith;
B. 
Comply in accordance with a time schedule set forth by the Town and state; or
C. 
Take appropriate remedial or preventative action in event of a threatened violation.
If the conditions of the permit or this Part 3 are not strictly adhered to, the permit shall be revoked.
