No person shall make any excavation, other than for the purpose of making the same suitable for use as a street or public highway, into any street shown on any plat on record in the Town Clerk's office without first obtaining permission so to do from the Town Council.
A. 
No person shall make any excavation on private property, other than for the cellar or foundation of a house or other building, within 100 feet of the street line of any street shown on any plat recorded in the Town Clerk's office, or within 100 feet of the property line of any abutting owner, without first obtaining a permit so to excavate from the Town Council.
B. 
No person shall make any excavation on any private property and remove therefrom the gravel or other soil so as to leave the same in a condition dangerous to the inhabitants of this Town, or otherwise in such condition as to create a nuisance, and no person shall make any such excavation or remove the gravel or other soil from any such property without first obtaining a permit from the Town Council.
Any person, firm or corporation violating any of the provisions of §§ 161-9 or 161-10 shall be fined not exceeding $100 or be imprisoned not exceeding 10 days in the Providence County Jail for each offense.
