Pursuant to municipal public utility law, N.J.S.A. 40:62-47 et seq.[1] and 40:63-1 et seq.,[2] there is hereby created a Municipal Water and Sewer Utility as an agency and instrumentality of the City of Margate City, County of Atlantic and State of New Jersey.

The Margate Water and Sewer Utility hereby created is a utility contemplated and provided for by Chapter 62, Public Utilities Municipally Owned, and Chapter 63, Sewers, Drains and Disposal Plants by a Single Municipality,[1] and shall have and exercise all of the powers and perform all of the duties provided for by said laws and any other statutes heretofore enacted thereto.

The Margate Municipal Water and Sewer Utility shall consist of three members who shall also be the three Commissioners of the City of Margate City. The Margate Municipal Water Utility heretofore created shall be merged into the joint creation of this Water and Sewer Utility, and all ordinances, resolutions and regulations and rules heretofore adopted by said Water Utility are herein confirmed and adopted by this joint utility.
