A. 
The existing Police Department of the Borough is hereby recognized and established as the Police Department of the Borough of Malvern. The Chief of Police shall be the chief executive of the Police Department, and under the direction of the Mayor, he shall be in charge of the police force and shall have supervision over its members in the exercise of their powers, duties and authority.
B. 
Further, the Borough Council, the Mayor, the Police Civil Service Commission and the Chief of Police will at all times maintain a Manual of Rules and Regulations specifying the rules and procedures to be followed with respect to the administration of the Police Department and the conduct of its employees. A copy of the Manual is to be provided to each employee of the Police Department.
Subordinate to the Chief of Police in the Police Department, who shall be designated as Captain, there shall be such other position classifications and ranks as established by the Council. The priority of authority among such subordinate classifications shall be in the order indicated by Council in its position and rank classification list. The number of persons to serve in each of such subordinate classifications on a full-time and/or part-time basis, and the compensation of each shall be as determined by the Borough Council from time to time.
Nothing herein contained shall affect the authority of the Mayor to appoint special policemen during emergencies.
A. 
Where the conduct or operation of supermarkets, shopping centers, banks, private parking areas, tournaments and other events of public assemblages where there are assembled large numbers of persons or there is need for the protection of cash and other property of such businesses, tournaments or public assemblages, the Chief of Police may, upon payment to the Borough of the sums hereinafter specified, supply the number of police he deems appropriate under the circumstances then prevailing to properly supervise and police such activities in order to maintain public order, the safe and efficient conduct of traffic on the highways and in, into and out of parking areas, and for the protection of money or other property and the supervision of attendance of the persons, customers and patrons attending such activities.
B. 
There shall be paid to the Borough of Malvern for the police service provided under the terms of this section the sum of $16 per hour, together with a service charge of $4 per hour, for each policeman for each such assignment; provided, however, that in no case shall such payment be for less than two hours, regardless of the time actually expended in the performance thereof. Such sums shall be payable to the Borough of Malvern for deposit into the Borough's general fund; provided, however, that the hourly rate may from time to time be changed by a duly enacted resolution of the Borough Council.
C. 
The Chief of Police shall keep an accurate record of all police officers who desire to perform such extra duty police services and, so far as is practicable under the circumstances, shall make such assignments on an equitable rotation basis. He shall further keep and maintain an accurate record of all such assignments of police officers to such extra or off-duty police services and shall certify the same to the Mayor, Police Committee and the Secretary-Manager at least once monthly.
D. 
Wherever possible, within 10 days from such submission by the Chief of Police to the Mayor, Police Committee and the Secretary-Manager as aforesaid, upon approval of the Mayor and Police Committee, such police officers shall be compensated for their services, at the rate provided for herein less the service charge and other appropriate deductions as shall from time to time be established by the Police Committee in accordance with applicable laws, ordinances and rules and regulations governing police compensation. All such compensation paid shall be included as part of police compensation for the purpose of pension compensation in accordance with the police pension program heretofore established.
E. 
During the time that such police officers are working such extra duty, they shall be entitled to all financial and fringe benefits to which they are entitled as police officers performing regular duty police services.
F. 
If at any time there are insufficient police officers available to supply such extra duty services from the list of policemen who desire such duty, the Chief of Police may assign men to such services during their regular duty police activities if in the Police Chief's judgment such assignment will not jeopardize normal police responsibilities and duties. In such event, however, such police officers shall not be entitled to receive additional compensation from that normally paid them for service during their regular duty hours.
