There is hereby established the position of Clerk.
A. 
The Clerk shall be appointed by the Township Committee, and the term of office of the Clerk shall be for three calendar years.
B. 
Any vacancy in said office shall be filled by appointment of the Township Committee.
C. 
Absence or disability. During the absence or disability of the duly appointed Clerk, Township Committee may, by resolution, appoint an officer or regular employee of the municipality to perform such duties of the Clerk during such absence or disability. Such absence or disability shall be limited to three months, after which time such absence or disability may be deemed a vacancy.
The Clerk shall be appointed on the basis of his/her executive and administrative abilities and qualifications with special regard to education, training and experience in governmental affairs.
The Clerk shall receive as salary such sums as may be fixed and adopted by the Township Committee in the annual Salary Ordinance of the Township.[1]

The Clerk shall be the chief administrator of the Township of Weymouth, and he/she shall be responsible to the Township Committee as a whole for the proper and efficient administration of the business affairs of the Township. His/her duties and responsibilities shall relate to the general management of all Township business, excepting therefrom those duties and responsibilities conferred upon other Township officials by state statute, other applicable laws, rules and regulations promulgated by state and county agencies, case decision or ordinance of the Township of Weymouth.
A. 
He/she shall supervise and direct the business activities of all Township departments, including the direction of central purchasing.
B. 
He/she shall serve as the personnel officer of the Township and as such shall study, recommend, implement and enforce personnel, organization and policy of the Township and its departments, after consultation with the Township Committee and department heads. He/she shall exercise supervisory responsibilities for personnel management and other statutory and nonstatutory duties as outlined in the Township of Weymouth's job descriptions.
C. 
He/she shall be responsible for the administration of the budget after its adoption by the Township Committee and the implementation of the work problems contained in the budget.
D. 
He/she shall execute and enforce the laws of the State of New Jersey and ordinances and resolutions of the Township of Weymouth as the Township Committee may prescribe.
E. 
He/she shall attend all meetings of the Township Committee and other committees as directed, with a right to take part in the discussion, and he/she shall receive notice of all regular and special meetings of the Township Committee and all advisory committees.
F. 
He/she shall keep the Township Committee informed as to the conduct of the Township's affairs, submit periodic reports, either in writing or orally, as the Township Committee shall request, and shall make such recommendations to the Township Committee as he/she deems necessary and advisable for the welfare of the Township.
G. 
He/she shall see that the provisions of all franchises, leases, permits and privileges granted by the Township are complied with.
H. 
He/she may recommend the employment of experts and consultants to perform work and render advice in connection with the operation of the dedicated utilities or work projects in the Township, subject to approval by the Township Committee.
I. 
He/she may attend to the lettering of contracts in due form of law and supervise the performance and faithful execution of the same except insofar as such duties are expressly imposed upon some other Township officer or official by statute.
J. 
He/she shall see that all money owed the Township is promptly paid, and that proper proceedings are taken for the security and collection of all the Township's claims.
K. 
He/she shall be the purchasing officer of the Township, and he/she shall purchase, in accordance with the provisions of the governing statutes and sound purchasing practices, supplies and equipment for the various agencies, boards, departments, and other offices of the Township. Prior approval of the departmental chairman shall be obtained for individual purchases exceeding $500. Purchases in excess of $2,500 shall be made according to state statutes and require approval of the Township Committee. For purchases made without prior approval of the Township Committee or committee chairman, at least two quotations shall be solicited from manufacturers, firms or dealers when the cost of the item purchased exceeds $250, and the purchase shall be made from the lowest responsible bidder when the kind and quality of the items are equal. He/she shall keep an account of all purchases and shall from time to time or when directed by the Township Committee make a full written report thereof. He/she shall also issue rules and regulations governing the requisition and purchase of all Township supplies and equipment consistent with the provisions of this article.
L. 
He/she shall review and recommend all bills and vouchers for payment prior to final approval by the Township Committee.
M. 
All complaints regarding services or personnel of the Township shall be referred to the office of the Clerk. He/she or an officer designated by him/her shall investigate and dispose of such complaints, and the Clerk shall keep a written record of such complaint and when and what action was taken in response thereto and provide to the Township Committee a copy thereof.
N. 
Except for the purpose of inquiry, the Township Committee shall deal with the administrative service solely through the Clerk, and neither the Township Committee nor any member thereof shall give orders to any subordinates of the Clerk, either publicly or privately.
O. 
He/she shall keep the Township Committee informed as to federal-aid projects and state-aid projects and any other projects and any other aid programs for which the Township of Weymouth may qualify.

Nothing in this article shall derogate from or authorize the Clerk to exercise the powers and duties of the elected and appointed officials of the Township, including statutory rights under N.J.S.A. 40:46-7. Furthermore, any of the duties enumerated in § 57-14 above may be assumed by the Township Committee directly or reassigned by the Committee to other employees at any time within the Committee's sole discretion with the exception of those duties that are the statutory responsibility of the Clerk pursuant to New Jersey Law. The reassigning of said duties shall be either by amendment to this article or by resolution of the Township Committee.
If any article, section, subdivision, sentence, clause or phrase of this article shall be held to be invalid for any reason, such decision shall not affect the remaining portions of this article.
All ordinances or parts thereof or resolutions inconsistent with the provisions of this article are hereby repealed to the extent of their inconsistency. Nothing in this article, however, shall affect the rights and tenure of any elected official.
A. 
This article shall take effect on January 1, 2003, after final passage and publication as required by law.
B. 
The position of Clerk shall be deemed to be established effective January 1, 2003.
Nothing in this article shall be construed to replace or amend the responsibilities of the Weymouth Township Municipal Clerk which is a position separate and distinct from Clerk. The Municipal Clerk shall also serve as the Clerk.
