The purpose of this article is to prohibit feeding of migratory waterfowl or to create conditions that may attract migratory waterfowl to public or private property in Weymouth Township.
As used in this article, the following terms shall have the meanings indicated:
MIGRATORY WATERFOWL
Any nondomesticated species of birds, such as swans, geese and river ducks and any other waterfowl otherwise defined under New Jersey or federal law as migratory waterfowl.
A. 
It shall be unlawful for any person to feed any migratory waterfowl on private or public property in the Township of Weymouth.
B. 
It shall be unlawful to allow any condition to exist which would result in an unreasonable attraction of migratory waterfowl.
A. 
Nothing in this article shall prohibit the use of bird feeders, which are raised at least four feet from the ground and are constructed in such a manner to prevent the unreasonable dissemination of bird seed on the ground below the bird feeders.
B. 
Nothing in this article shall be construed to prohibit the feeding of migratory waterfowl contained in an agricultural capacity, nor shall it be construed to prohibit the feeding of migratory waterfowl as directed by the New Jersey Department of Environmental Protection (NJDEP) or other appropriate governmental or nonprofit agencies.
C. 
Nothing in this article shall prohibit the holder of a valid hunting license to engage in baiting as permitted according to state and federal law.
This article shall be enforced by the Code Enforcement Officer for the Township of Weymouth.
Any person who is found guilty of violating any provision contained in this article shall be punished by a fine not less than $5 and not more than $500.
