The elective officers of the city shall be a Mayor, seven (7) Councilmen which number shall include a Councilman at Large, a Judge of the City Court and five (5) members of the Board of Water Commissioners.[1] The Mayor, the Councilman at Large, the Judge of the City Court and the members of the Board of Water Commissioners shall be elected by the city at large, and one (1) Councilman shall be elected by the qualified voters of each ward. All elected city officers shall be elected at the general election in odd-numbered years, for a term of four (4) years, except the Judge of the City Court who shall be elected for a term of six (6) years.

A. 
No person shall be elected to a city office unless he shall at the time be a resident elector of the city; nor to the office of Councilman (except the Councilman at Large) unless he be a resident elector of the ward for which he was elected.
B. 
Every elected or appointed City officer shall possess the qualifications prescribed by Section 3 of the Public Officer's Law, except that all appointed unpaid Board and Commission members must be residents of Fulton County, New York and the following appointed City officers must be residents of Fulton County or any contiguous county of Fulton County: City Assessor, City Clerk-Deputy Health Registrar, Deputy City Clerk-Health Registrar, Commissioner of Finance, Deputy Commissioner of Finance, City Attorney, Mobility Manager, DPW Director and Human Resources Manager. Preference for both appointed unpaid Board and Commission members and appointed City officers will be given first to qualified applicants who live in the City of Gloversville.

C. 
Every paid firefighter for the City of Gloversville must be a resident of Fulton County, New York.

A. 
All nonelected officers of the City of Gloversville shall be appointed by the Mayor subject to the approval of the Common Council, except for the City Clerk and the Deputy City Clerk, who shall be appointed by the Common Council. Every nonelected city officer shall possess the qualifications prescribed by § 3 of the Public Officers Law except as otherwise provided in this Charter.
B. 
The nonelected officers of the City of Gloversville shall be a Commissioner of Finance, a Deputy Commissioner of Finance, a City Clerk, a Deputy City Clerk, a City Attorney, an Assessor, a Director of Public Works, a Building Inspector, a Commissioner of Health, members of the Planning Board, members of the Zoning Board of Appeals, and officers or members of boards, commissions or committees which are appointed pursuant to §§ C-10A and C-31.
Nonelected officers for whom no other term of office is provided in this Charter or any other law shall be appointed annually and shall hold office at the pleasure of the appointing officer or body. Any officer permanently appointed to an office classified in the competitive class of the civil service shall hold such office for an indeterminate term subject to the provisions of the Civil Service Law.
An officer appointed for a specified term may be removed by the Common Council for cause upon request of the appointing officer or body (or upon the Common Councils own initiative) after giving such officer a copy of the charges and a hearing upon not less than ten (10) days' notice at which he may appear in person or by counsel and present witnesses and evidence in his own behalf and cross-examine witnesses. The decision of the Common Council shall be subject to review pursuant to New York State Law.
The salaries and compensation of all officers and employees of the city, whether elected or appointed, shall be fixed by the Common Council, except such officers and employees who are required to serve without compensation.
Any officer or employee of the city may be paid, in addition to his salary, the actual amount of expenses incurred by him in the performance of duties imposed upon him by this Charter, by any local law, ordinance, regulation or rule of the City of Gloversville, or by the laws of the State of New York. All such expenses, including mileage, shall be paid out of funds appropriated for the respective departments, bureaus or offices in which such officers or employees are employed, and claims therefor shall first be approved by the head of such department, bureau or office before payment.
Except where authorized by this Charter or by law:
A. 
No Councilman or Mayor shall hold any other city office or city employment.
B. 
No former Councilman or Mayor shall hold any compensated nonelected city office or city employment until one (1) year after the expiration of the term for which he was elected or the date of his resignation from office.
A. 
Whenever any elected city officer shall cease to be a resident of the city or whenever any appointed unpaid Board or Commission member or city officer exempted from city residence by the provisions of Article II, § C-9B, shall cease to be a resident of Fulton County, New York, or any other appointed city officer shall cease to be a resident of the City of Gloversville, New York, the officer's office thereby shall become vacant. Whenever any Councilmember shall cease to be a member of the ward from which elected, said office shall thereby become vacant.

B. 
A vacancy in an elective office shall be filled by election for the remainder of the unexpired term, if any, at the next general election following not less than sixty (60) days upon the occurrence of the vacancy; provided, however, that the Common Council, by a majority vote of all its remaining members, shall, within thirty (30) days, appoint a qualified person to fill the vacancy for the period until the person elected to serve the remainder of the unexpired term takes office. A City Councilman shall be eligible for appointment to fill a vacancy in the office of Mayor. If a Councilman shall be so appointed, his office as Councilman shall thereupon become vacant.
C. 
If a vacancy shall occur in any nonelected office of the city otherwise than by expiration of term, the officer or body authorized to make the original appointment of such officer shall appoint a person to fill said vacancy for the balance of the unexpired term. Such appointment shall be approved by the Common Council.
Each elected and appointed officer of the city, before taking office shall take and file the constitutional oath of office as required by § 10 of the Public Officers Law.
The Commissioner of Finance, the Deputy Commissioner of Finance, the City Clerk, the Deputy City Clerk and such other officers and employees as may be required by the Common Council shall file an official undertaking in such sum and form and with such sureties as the Common Council shall direct. The Common Council may by resolution determine that such undertaking shall be executed by a surety company authorized to transact business in the State of New York and that the expense thereof shall be a charge upon the city. The city may also provide blanket undertakings as authorized by the Public Officers Law. All official undertakings shall be filed in the office of the City Clerk, except that the official undertaking of the City Clerk shall be filed in the office of the Commissioner of Finance.
