The Board of Commissioners, being the municipal authority of the Township of Lower Pottsgrove, hereby signifies its intention to organize an authority under the provisions of the Municipality Authorities Act of 1945, as amended.[1]

The President of the Board of Commissioners and the Secretary of the Board of Commissioners of Lower Pottsgrove Township are hereby authorized and directed to execute on behalf of the Board of Commissioners of Lower Pottsgrove Township Articles of Incorporation for said Authority, providing that, among other things:
A. 
The name of the Authority shall be "Lower Pottsgrove Township Authority."
B. 
The Authority is formed under the Act of May 4, 1945, P.L. 382, as amended by Act No. 571, June 12, 1957, and Act No. 2188, January 21, 1952, known as the Municipal Authorities Act of 1945.
C. 
The purpose of the Authority shall be to engage in acquiring, holding, constructing, financing, improving, maintaining and operating, owning and leasing projects of the kind and character contemplated by law for a general purpose authority as authorized and permitted by and also limited by provisions of the Municipality Authorities Act, Act of May 2, 1945, P.L. 382, as amended and supplemented, and by any other applicable statute of law.
D. 
The name of the incorporating municipality is the Township of Lower Pottsgrove and setting forth the names and addresses of the municipal officers constituting the municipal authorities of said municipality, to wit: (Here followed the names and addresses of the municipal officers.)
E. 
The names, addresses and terms of office of the first members of the Board of the Authority are as follows: (Here followed the names, addresses and terms of office of the first members of the Board.)
F. 
The term of existence of Lower Pottsgrove Township Authority shall be for a period ending September 30, 2041.
The said L. Sharpless Galloway, Terrence D. Kacik, Joseph Hinkel, Donald Koshiek and Robert Reber[1] are hereby appointed by the Board of Commissioners of Lower Pottsgrove Township for terms of office expiring one year, two years, three years, four years and five years, respectively, from September 1, 1964.

The proper officers of the Board of Commissioners of Lower Pottsgrove Township are hereby directed as required by the Municipality Authorities Act of 1945, as amended, to publish notice of this chapter and of the day upon which said Articles of Incorporation, together with a certified copy of this chapter, authorized the incorporation of the Authority and the necessary proofs of publication with the Secretary of the Commonwealth and to do all other things necessary or appropriate to effect the incorporation of the Lower Pottsgrove Township Authority.
The purposes for which the Authority is organized shall be to acquire, hold, construct, improve, maintain, operate, own, lease, either in the capacity of lessor or lessee, projects of the following kind and character, buildings to be devoted wholly or partially for public uses, transportation, marketing, shopping, terminals, bridges, tunnels, flood control projects, highways, parkways, traffic distribution centers, parking spaces, airports and all facilities necessary or incident thereto, parks, recreation grounds and facilities necessary or incident thereto, parks, recreation grounds and facilities, sewers, sewer systems or parts thereof, sewage treatment works, including works for treating and disposing of industrial waste, facilities and equipment for the collection, removal or disposal of ashes, garbage, rubbish and other refuse materials by incineration, landfill or other methods, steam heating plants and distribution systems, incinerator plants, waterworks, water supply works, water distribution systems, swimming pools, playgrounds, lakes, low head dams, hospitals, motor buses for public use, when such motor buses are to be used within any municipality and subways.
The first project to be undertaken is to acquire, construct and erect a municipal sewage treatment system and plant and to operate the same.
