The purpose of this article is to protect the health, safety and welfare of the residents within the external boundaries of the Menominee Indian Reservation by preventing erosion of Dam No. 3 caused by needless off-road traveling on said dam which could lead to its failure.
The jurisdiction of this article shall include all lands and waters within the exterior boundaries of the Menominee Indian Reservation.
As used in this article, the following terms shall have the meanings indicated:
DAM NO. 3
The dam located on Linzy Creek in the NW 1/4, NE 1/4 of Section 23, Township 28 North, Range 16 East, Menominee County, on the Menominee Indian Reservation.
UNPAVED AREAS OF DAM
All areas of Dam No. 3, including but not limited to the public right-of-way and public access area. It does not include the normally traveled, hard-paved road or gravel shoulder.
VEHICLE
Any instrument of human transportation or conveyance, including but not limited to automobiles, trucks, motorcycles, dirt bikes, four-wheel-drive vehicles, all-terrain vehicles, bicycles or any other motor-driven or human-propelled vehicles.
It shall be illegal for anyone, without express authorization pursuant to this article, to do any of the following:
A. 
Drive or travel with a vehicle on any of the unpaved areas of the normal roadway of Dam No. 3.
B. 
Park any vehicle on Dam No. 3 off the gravel margin immediately adjoining the hard-paved roadway.

This article shall be enforced by the Menominee Tribal Police Department and any duly authorized tribal conservation officers.
Any individual violating § 550-11A and B of this article shall be, upon conviction, penalized as follows: a fine not to exceed $500, plus court costs, or a jail term not to exceed six months in jail, or both a fine and a jail term not to exceed the above-stated maximum amounts.
