[HISTORY: Adopted by the Township Committee of the Township of Mansfield 2-29-1972, as amended through Ord. No. 9-88 (§ 2-2 of the 1975 General Ordinances). Subsequent amendments noted where applicable.]

§ 18-1 Established.

A municipal court is hereby established in the Township, to be known as the "Municipal Court of the Township of Mansfield."

§ 18-2 Seal.

The court shall have an official seal which shall bear the impress of the name of the court.

§ 18-3 Judge. [1]

There shall be a judge of the court, who shall hold office for the term, and who shall be appointed in the manner provided by N.J.S.A. 2B:12-4; and who shall have the qualifications prescribed by N.J.S.A. 2B:12-7.

§ 18-4 Administrator. [1]

There shall be an Administrator of the court and such other clerical assistants as may be determined necessary by resolution or ordinance.

§ 18-5 Salary. [1]

The compensation of the judge and the Administrator of the municipal court and such other personnel as may be required and appointed by the Township Committee, shall be by annual salaries fixed by the Township Committee by ordinance; provided, the Township Committee may, by ordinance or resolution, designate any officer or employee of the Township to serve as violations clerk of the court of the Township with or without additional compensation.[2]

§ 18-6 Bond. [1]

Before entering upon the duties of their respective offices, the judge and the Administrator and violations Clerk thereof, shall enter into a bond to the Township of Mansfield and to the County of Warren and the State of New Jersey, in such amount and with such surety as the Township Committee may fix, conditioned upon the faithful performance of its respective duties of such officers.

§ 18-7 Rules governing court.

All administrative matters, fees, costs and all procedural rules and regulations shall be governed and controlled by the provisions of appropriate statutes in such case made and provided, by the rules prescribed by the New Jersey Supreme Court governing the courts of the State of New Jersey, and the regulations and directives of the administrative office of the courts of New Jersey, regarding procedure in municipal courts.

§ 18-8 Territorial jurisdiction. [1]

The territorial jurisdiction of the municipal court of the Township shall be that territory embraced within the municipal boundaries of the Township and as provided in N.J.S.A. 2B:12-16.[2]

§ 18-9 Statutory jurisdiction. [1]

The municipal court of the Township and the judge thereof shall have jurisdiction over all of the offenses set forth in N.J.S.A. 2B:12-17, together with any other matter concerning which jurisdiction shall by statute, be conferred upon municipal courts of this state.
