It is the purpose of this Article to promote the health, safety and general welfare of the inhabitants of the Town of Oneonta. It is further a recognition that the Town of Oneonta is the steward of the air, water, land and living resources and thereby has an obligation to protect the environment for the use and enjoyment of this and all future generations; it is further recognized that the protection and enhancement of the environment, human and community resources be given appropriate weight with the social and economic considerations in public policy, and that those factors be considered in reaching decisions on proposed activities. It is also recognized that a suitable balance of social, economic and environmental factors be incorporated into the planning and decision-making processes of local agencies in the implementation of the State Environmental Quality Review Act, Article 8 of the Environmental Conservation Law.
A. 
In addition to Type 1 actions as enumerated in 6 NYCRR 617.12, the following actions have been determined to have a significant effect upon the environment in the Town of Oneonta and therefore require the preparation of an environmental impact statement:
(1) 
Any nursing home or mental facility, drug rehabilitation center, alcoholic rehabilitation center, family-care home, adult home, halfway house, day-care center.
(2) 
Any permanent establishment housing 50 or more people as residents.
(3) 
Any mining operation, including but not limited to the mining of sand and gravel.
B. 
These actions are not exhaustive of all actions other than those specifically enumerated in 6 NYCRR 617.12, and the Town of Oneonta reserves the right to amend this Article to include additional specific acts it determines will have a significant effect upon the environment of the Town of Oneonta.
