There shall be within the Town of Oneonta a Department of Highway, Water and Sewer, which shall incorporate the functions previously performed by the Highway Department and Water and Sewer Department of the Town of Oneonta.
There shall be created the office of Town of Oneonta Superintendent of Highway, Water and Sewer who shall be the duly elected and acting Superintendent of Highways as authorized by § 20 of the Town Law of the State of New York and § 140 of the Highway Law of the State of New York. The Superintendent of Highway, Water and Sewer shall be vested with all power and authority as established by the Town Law of the State of New York and the Highway Law of the State of New York. In addition, the Superintendent of Highway, Water and Sewer shall be vested with such additional responsibilities as may be determined and modified from time to time by the Town Board by resolution enacted pursuant to the authority created by this chapter. The Town Superintendent of Highway, Water and Sewer shall have direct supervision and control over all employees assigned to the Town of Oneonta Department of Highway, Water and Sewer. All employees of the existing Town of Oneonta Highway, Water and Sewer Departments shall be designated as employees of the combined Department of Highway, Water and Sewer as created by this chapter.
Nothing in this chapter shall be construed to modify, amend or supersede the powers and duties as established pursuant to the provisions of the Town Law or the Highway Law of the State of New York for the position of Town Superintendent of Highways. Nothing in this chapter shall be construed to alter or amend the elective office of Town Superintendent of Highways as established therein. It is the specific intent of the Town Board to confer additional supervisory authority and duties to the Town Superintendent of Highways over the newly created Department of Highway, Water and Sewer, as authorized under the provisions of § 32 of the Town Law of the State of New York.
Nothing in this chapter shall modify, amend or supersede the provisions of the Town Law with regard to allocation of funds and expenses between the former Town Highway Department and the sewer and water districts for which services are provided by the newly created Town Department of Highway, Water and Sewer. Any expenditures or charges previously attributable to the Town Highway Fund shall remain charges thereto, and any charges or expenditures as previously attributable to the respective water and sewer districts of the Town of Oneonta shall remain charges or expenditures therefore.
