A. 
The Town of Oneonta maintains a right-of-way 50 feet from the center of Town-owned roads onto adjacent private property.
B. 
In this right-of-way, property owners continue to own and maintain their lawns, fences, trees, shrubs, driveway entrances, hedges or decorative placements.
Within the right-of-way, the Town of Oneonta is authorized to remove, or may direct to be removed, any and all obstacles, culverts, shrubs, decorative placements, ornaments, fences, trees, otherwise maintained, constructed or placed by property owners, when in the judgment of the Town of Oneonta, the tree, object, greenery, fence, etc. is:
A. 
A hazard to motorists;
B. 
An obstruction to sight distance;
C. 
An imminent threat to safe passage on the Town's road;
D. 
An impediment to maintenance, improvement or widening of a roadway;
E. 
Necessary to improve drainage and avert flooding of the Town's road.
An owner of land abutting a Town highway has a right and a duty to maintain lawns, trees, shrubs, driveways, fences, etc. within the Town's right-of-way so long as they do not interfere with or impair the safety of the traveling public or the Town's right to maintain and improve the roadway.
If the Town of Oneonta removes, or directs to be removed, any obstacle or barrier within its right-of-way, the Town will give property owners prior written notice.
Prior to the removal of any obstacle or barrier, including but not limited to tree removal, the Town Highway Superintendent shall obtain bids or estimates pursuant to and consistent with the Town's purchasing policy.
If the Town of Oneonta removes any obstacle within its right of way, the area will be appropriately cleaned and all debris removed.
When a paving or road reconstruction project involves new paving and the height or location of a driveway entrance is changed, the Town will return the entrance to a useable condition conforming to the new road.
