The license and inspections fees per annum shall be the sum of $13 per pad. Said fees are hereby expressly declared to be imposed for regulation and revenue and shall be payable in advance.
A. 
The owner of each mobile home shall pay a municipal services fee the first day of each month as set forth below:

The municipal services fee shall be collected by the mobile home park owner in which a mobile home is located. The mobile home park owner shall issue a receipt to the mobile home owner upon collection of the fee.
C. 
The park owner shall transmit the appropriate fee for each occupied space whether or not the home is occupied, and a copy of a receipt issued for each fee shall be transmitted to the Tax Collector. Said payment shall be paid at least once per month no later than the 10th day of each month by the park owner to the municipality.
D. 
Any fee imposed by this section which shall remain unpaid after 10 days from when it is due shall be deemed delinquent. Delinquent fees shall bear an interest rate of 18% per annum to be charged to the mobile home owner for nonpayment or the mobile home park owner for failure to transmit such fees in accordance with this section. Delinquent fees which remain unpaid after 30 days shall become a municipal lien against the real property upon which the mobile home park is situated. Such municipal lien may be enforced by the Township Tax Collector by selling the property in the manner set forth in N.J.S.A. 54:5-19.
E. 
The municipal service fee shall be established annually at the time that the municipal tax rate is established. The fee shall be calculated as follows:
(1) 
Adjusted municipal budget appropriations (AMBA) shall be the local municipal budget appropriations less anticipated surplus, miscellaneous revenues, receipts from delinquent taxes and tax revenues from nonresidential uses.

(2) 
In no event shall the above formula result in a municipal service fee of less than $104 per year nor more than one $156 per year.
F. 
The municipal service fee shall be prorated for each calendar month a mobile home space remains unoccupied.
G. 
The municipal service fee, to the extent it constitutes a new or increased fee, may constitute a rent surcharge collectible in addition to any surcharge or increase permitted under Article I of Chapter 204.
H. 
The mobile home park owner shall pay to the Township Tax Collector each month, as set forth above, the municipal service fee for every mobile home located within the mobile home park regardless of whether the mobile home is occupied or whether the mobile home owner pays the municipal service fee to the mobile home park owner.

I. 
The mobile home owners shall pay the municipal service fee to the mobile home park owner as set forth above, in an amount equal to 1/12 of the yearly amount, on the first day of each month.
J. 
All municipal service fees, paid monthly, and submitted to the Township Tax Collector, shall be submitted with a list identifying all mobile home spaces/pads that are rented including current tenant information. A separate list of all owner-occupied mobile homes must also be provided. The lists should include the first and last name, mobile home address, and responsible party address if different than mobile home address.

K. 
Any violation of this article shall be subject to the violations and penalties set forth in § 204-25.
