There is hereby established an employment practice which will engender the public's confidence in its decisions as they relate to the hiring of individuals who are related to members of elected and appointed governing body and eliminate the potential for preferential treatment of the relative of governmental personnel.
As used in this article, the following terms shall have the meanings indicated:
ELECTED OFFICIAL
Persons holding the position of Mayor and/or Township Council.
LOCAL GOVERNMENT AGENCY
A board, authority, committee or other instrumentality within the Township of Manchester, County of Ocean, State of New Jersey.
RELATIVE
A parent, spouse, child, sibling, grandparent, grandchild, aunt, uncle, nephew, niece, cousin, in-law or step-relative, domestic partner or cohabitant.
SUPERVISOR
Any employee of the Township of Manchester having supervisory duties and powers over another employee or employees within the respective department of the Township.
A. 
The elected officials, department heads, supervisors and administrators shall not have the authority to employ for compensation any individual classified under this article as a relative.
B. 
No relative of the elected officials, department heads, supervisors or administrators shall be hired to represent, appear for or negotiate on behalf of the Township of Manchester before any local government agency or authority.
C. 
The elected official, department head, supervisor or administrator shall not have the authority to hire for compensation or cause to be hired within his or her department any individual who is a relative of the Mayor, any member of the Township Council, department head, supervisor or administrator of another department.
D. 
No elected official, department head, supervisor or administrator may participate in the promotion process or hiring process in any department of any existing employee who is a relative of such elected official, department head, supervisor, or administrator, as the case may be. Such elected official, department head, supervisor or administrator shall abstain from participation in such personnel action as it applies to such relative.
A. 
The provisions of this article shall apply to all future hirings within the Township of Manchester after the effective date of this article.
B. 
The provisions of this article shall not apply to seasonal, part-time employees of the Township of Manchester.
C. 
The provisions of this article shall not apply to employees whose employment is contingent upon open competitive examination.
D. 
The provisions of this article shall not apply to essential positions in situations where no other applicants have applied for the position.
Except as may otherwise expressly provided for herein, the provisions of this article shall not affect the employment of any present Township employees and/or any existing contractual obligations with employees by the Township of Manchester.
