No person shall drink any alcoholic beverage or possess any open beverage container containing any alcoholic beverage in any public place not duly licensed to sell the same for on-premises consumption in the Town of Newfane or in any parked, standing or moving vehicle in any public place in the Town of Newfane.
This chapter shall apply throughout the Town of Newfane, except in any municipal park or marina situate in the Town of Newfane.
As used in this chapter, the following terms shall have the meanings indicated:
ALCOHOLIC BEVERAGE
Includes alcohol, spirits, liquor, wine, beer, hard cider and every liquid or solid, patented or not, containing alcohol, spirits, wine or beer and capable of being consumed by human beings.
PUBLIC PLACE
Any place to which the public or a substantial group of persons has access, including but not limited to highways, streets, sidewalks, recreation areas, transportation facilities, places of amusement, churches and church grounds, playgrounds, schools and school grounds and hallways, lobbies and other public portions of apartment houses, hotels or housing complexes or housing developments not constituting rooms or apartments designed for actual residence.
Every person who shall violate the provisions of this chapter shall, upon conviction thereof, be punished by a fine not to exceed $250 or by imprisonment not to exceed 15 days, or by both such fine and imprisonment.
