Prior to the undertaking of any public improvement project (construction of all roadway pavements, curbs, sidewalks, storm sewers and other drainage facilities, water and sewer systems and appurtenances, streetlights and any other required utilities and public improvements), the proposed developer or contractor must provide five copies of a map or survey and proposed plans and specifications prepared by an engineer duly licensed by the State of New York and comply with all other provisions of Town Law and other applicable laws.
Prior to beginning any construction of said public improvements, the applicant/developer shall obtain a public improvement permit and shall also pay a public improvement project fee to the Town of Newfane, which fee shall be sufficient to cover the cost of review of such plans and specifications by an engineer and legal counsel retained by the Town for such purpose and to cover the cost of inspection fees for inspectors to monitor the construction of said improvements to ensure that they are constructed in accordance with the plans and specifications and meet all Town standards for such construction, which inspectors shall be employees of a qualified engineering firm approved by the Town. The Town Board shall not accept conveyances of any public improvement project unless all of the provisions of this chapter are complied with fully.
The Town Board of the Town of Newfane hereby adopts a fee schedule of 10% of the estimated construction costs to be held in escrow as public improvement fees payable to the Town in advance of commencing construction. This schedule shall be subject to further review and modification from time to time. The Town Engineer shall approve estimated construction costs at final plat approval.
Following the completion of the public improvement project, four sets of as-built drawings shall be supplied to the Town, at no cost to the Town.
In all use districts except residential districts, the site plans for the use of any of said premises or for the erection, installation, construction, development or the placing of any structure or building on such premises or the installation or construction of parking lots or parking areas or any other facilities of any nature or kind shall be reviewed and approved by the Planning Board of the Town of Newfane prior to the commencement of construction, installation or development and shall be installed or constructed in accordance with standards, specifications and procedures acceptable to or required by the appropriate Town, county or state departments and this chapter.
