As used in this chapter, the following terms shall have the
meanings indicated:
PERSON
Includes an individual, society, club, firm, partnership,
corporation or association of persons, and the singular number shall
include the plural number.
No person shall conduct, operate or carry on a public place
of amusement for money or hire, such as a dance hall or place where
dancing is permitted, a circus, theater, pool or billiard parlor,
bowling alley, shooting gallery, skating rink, an athletic contest
or exhibition, show or other exhibition or performance, an amusement
park or place where machines or other devices are maintained on or
by which games or contests may be played by guests or patrons for
their amusement or where other games or forms of amusement are conducted
for or by the patrons thereof, unless the owner or operator of such
place shall first secure a license to conduct or operate such place
from the Town Board of the Town.
Any person desiring such a license shall make a written application
therefor to the Town Clerk and shall pay a fee of $1 for each operation
if such license is issued. The Town Clerk may provide suitable forms
to be used for such applications. The Town Clerk shall immediately
submit all such applications to the Town Board for approval, and if
such application is so approved, the Town Clerk shall thereupon issue
to the applicant a license for such purpose or purposes.
This chapter shall not apply to baseball games or to athletic
or social activities of churches, incorporated fire companies, fraternal
organizations or to public or private schools and shall not be construed
to authorize any form of activity otherwise illegal or contrary to
law or public policy.
Any such license may be issued for a period of one year, but
all licenses shall expire on the first day of January succeeding the
date thereof.
Any person violating any of the provisions of this chapter shall
be guilty of a misdemeanor and, upon conviction thereof, shall be
punishable by a fine of not exceeding $50 for the first offense and,
for a second or subsequent offense, by a fine not exceeding $50 or
by imprisonment in the county jail, or by both such fine and imprisonment.
