Ordinance No. 2427 is hereby repealed.
The purpose of this article is to provide guidelines and rules for the use of municipal vehicles and the use of the personal vehicles of municipal employees for municipal business.
This Municipal Manager shall be responsible for the administration of this article. This article shall supersede all other policies and regulations regarding the use of municipal vehicles and the use of the personal vehicles of municipal employees for municipal business.
Annually, during the preparation of the municipal budget, the Municipal Manger, in consultation with department heads, shall review the individuals with take-home municipal vehicles and determine if such use is warranted due to the nature of the job assignment in question. Provided, however, this provision shall not be construed to prevent the Municipal Manager from assigning or revoking the use of a take-home municipal vehicle for violation of the rules and regulations established in this article.
The following rules of use and operation shall apply to all municipal vehicles. If, in addition to these rules, any department of the Municipality has adopted more restrictive rules, the more restrictive rules of that department shall apply:
A. 
Municipal vehicles shall be used only for the performance of municipal business, including meetings, off-site training, conferences or other business related events. As approved, assigned municipal vehicles may be driven to and from work. Municipal vehicles shall not be used for private or personal business of any kind.
B. 
Municipal vehicles shall not be used for the transportation of family members or other persons not related to municipal business.
C. 
Municipal vehicles shall at all times be operated in accordance with applicable laws and operated in a safe and courteous manner.
D. 
Except as required in the performance of municipal business, no alcohol, controlled or prohibited weapons shall be carried in a municipal vehicle.
E. 
In the event an employee is to be absent from work for more than five days, the municipal vehicle shall be returned to the municipal workplace until the employee returns to work.
F. 
Any employee operating a municipal vehicle must possess a valid driver's license and must report any suspension of driver's license privileges to the Municipal Manager.
Employees assigned a vehicle shall be responsible for the cleanliness of the vehicle, and shall promptly report any mechanical failure or damage to the vehicle to the Municipal Manager.
All take-home privileges are at the discretion of the Municipal Manager; however, the following events shall constitute grounds for revocation of such privileges:
A. 
Failure to comply with the rules and regulations established in this article.
B. 
A change in job assignment where such privileges are no longer warranted.
C. 
The determination by the Municipal Manager that such revocation is in the best interest of the Municipality.
Mileage reimbursement requests for use of personal vehicles for municipal business shall be made on the prescribed form and submitted for review and approval to the department head and Municipal Manager on a monthly basis, no later than the fifth day of the following month. All reimbursements shall be made at the prevailing IRS rate.
All ordinances or parts of ordinances which are inconsistent with this article shall be repealed.
If any section, subsection, paragraph, sentence, clause, phrase or portion of this article is for any reason held invalid or unconstitutional by any court of competent jurisdiction, or by the adoption of preemptive legislation of any kind, such determination shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions of this article.
This article shall take effect immediately upon adoption.
