A. 
All persons hired on or appointed after Town Board approval, to any full or part-time position, shall have their principal residence within the limits of the Town of Niagara. Persons may be hired on a provisional basis and given six months from the date of hire to establish a permanent residence within the Town of Niagara at the discretion of the Town Board.
(1) 
This legislation may be modified, or removed, at the discretion of the Town Board.
(2) 
Persons presently occupying any position who currently live within the Town of Niagara, and hired prior to Town Board approval, must maintain their principal residence within the Town limits during the term of their employment.
(3) 
Persons presently occupying any full-time position who currently do not live within the Town of Niagara, and hired prior to Town Board approval, will be grandfathered and exempt from this policy.
(4) 
If a situation occurs where there are no qualified Town of Niagara residents for a particular position, nonresidents may be considered at the discretion of the Town Board.
(5) 
Responsibility: It shall be the responsibility of the Supervisor's Office and/or Human Resources Department to insure compliance with this policy.
(6) 
Definition of an employee: An employee is any person appointed to any position of employment.
(7) 
Principal place of residence is defined as that place which the employee declares his/her home for voting purposes or with the intent to remain there permanently for a definite, indefinite or undetermined length of time.
(8) 
All employees shall report changes of principal addresses to their respective department head within five working days from the date of the change in address.
(a) 
Failure to comply with any of the provisions addressed in this policy could result in termination.
(9) 
Where the Town Board, after investigation, determines that there is difficulty in the recruitment of personnel for a position and that to restrict recruitment of personnel to Town residents would not be in the public interest, the Town Board shall adopt an appropriate resolution establishing the public interest involved and the position or positions to which such waiver of the residency requirements shall apply and the time frame within which such waiver shall apply.
B. 
This policy shall be effective immediately upon approval of the Town Board. This policy shall replace any previous residency policies or standards and shall remain in effect until replaced by subsequent Town Board resolution or local law. Any exceptions to this policy regarding the hiring of any employee must be approved by a majority vote of the Town of Niagara Town Board.
