There shall be hereafter assessed a sum of $2
as part of the costs in each civil action filed in the Combined District
Courts of the City of Galax and criminal or traffic cases in the Combined
District Courts of the City of Galax, Virginia, in which the defendant
is convicted of violation of any statute or ordinance, to be used
for the funding of courthouse construction, renovation or maintenance.
Such assessment of the courthouse construction,
renovation or maintenance fee shall be collected by the Clerk of the
Combined District Courts, remitted to the Finance Director of the
City of Galax, who shall hold such amounts subject to appropriation
by the City Council of the City of Galax, Virginia, for the funding
of construction, renovation or maintenance of courthouse and court-related
facilities and to defray increases in the cost of heating, cooling,
electricity and ordinary maintenance. Notwithstanding any other provision
of this article, no fee shall be assessed in cases where no costs
are assessable.
Such assessment for courthouse construction,
renovation or maintenance shall be in addition to any other fees prescribed
by law.
