It is the intent of the governing body pursuant to the following to establish responsibility in the Borough of Haddon Heights for maintenance of the area within the public right-of-way between private property lines and the cartway of the street in the Streetscape Project Area and to establish certain standards for maintenance by property owners located within that area.
As used in this article, the following terms shall have the meanings indicated:
STREETSCAPE PROJECT AREA
Encompasses the 500 and 600 blocks of Station Avenue as well as the portions of Seventh Avenue, White Horse Pike and Atlantic Avenue upon which period lighting and/or brick pavers were installed under the Haddon Heights Streetscape Project. This area shall also encompass the 700 block of Station Avenue under Phase II of the project.
A. 
The record owner of any property in the Streetscape Project Area in the Borough of Haddon Heights shall be responsible for the maintenance of the area within the abutting public right-of-way between the property lines of the premises and extending to the cartway line.
B. 
Maintenance responsibility shall include but not be limited to the following:
(1) 
Removal of any and all weeds, litter and other debris.
(2) 
Sweeping or washing of sidewalks and gutters and keeping said area in a dust-free condition.
(3) 
Repairing, patching, restoring or replacing all improvements, including sidewalk, landscape and curbing, where the same is occasioned by the owner's negligence or carelessness or at the owner's action or direction.
(4) 
Maintaining the premises in accordance with the terms, conditions and requirements of the BOCA National Property Maintenance Code adopted pursuant to § 348-1.
C. 
Responsibilities of the owner shall not include any streetlight, traffic control signage, regulatory signage, trash receptacles, public benches, bicycle racks, or any other equipment owned or maintained by a public utility.
