As used in this article, the following terms shall have the meanings
indicated:
CLAIMANT
A person or persons who filed a claim for sewer rental rebate and
was 65 years of age or over and whose spouse, if residing with the claimant,
was 65 years of age or over during the calendar year in which sewer rentals
were due and payable. If sewer rentals are charged to more than one individual,
the number of persons to whom the sewer rental is charged shall be considered
the "claimant."
HOUSEHOLD INCOME
All income received by the claimant during a calendar year for which
the sewer rental rebate is being claimed.
INCOME
All income from whatever source derived, including but not limited
to salaries, wages, bonuses, commissions, income from self-employment, alimony,
support money, cash, public assistance and relief; the gross amount of any
pensions or annuities, including railroad retirement benefits and all benefits
received under the Federal Social Security Act, except Medicare; all benefits
received under state unemployment insurance laws and veterans' disability
payments; all interest received from the federal or any state government or
any instrumentality or political subdivision thereof; realized capital gains,
rentals, workmen's compensation and the gross amount of life
insurance benefits and proceeds, the gifts of cash or property in excess of
$300, but shall not include surplus food or other relief in kind supplied
by a governmental agency.
Any claimant may claim a sewer rental rebate for any calendar year after
the close of the calender year for the amount of sewer rentals paid by the
claimant during the said calendar year.

No claim shall be allowed for any claimant whose income is in excess
of $12,000 per year for the entire calendar year in which the claim is filed.
A claim for sewer rental rebate shall be filed with the Secretary of
the Borough of Media within 90 days succeeding the end of the calendar year
in which the sewer rentals for which the rebate is claimed were due and paid,
and no claim shall be made from the general fund of the borough earlier than
60 days after the last day on which such claim may be filed.
Each claim shall be filed on forms provided by the Borough of Media
and shall include reasonable proof of household income, the receipts or other
proof that the sewer rental bills had been paid during the calendar year and
proof of the age of the claimant.
The Council of the Borough of Media may prescribe necessary rules and
regulations and shall make available suitable forms for filing a claim.
In any case in which a claim is filed with fraudulent intent, the claim
shall be disallowed and the claimant prohibited from filing any future claims.
The Secretary of the Borough of Media is hereby empowered to determine
the validity of any claim. Appeals from any action or determination of the
Secretary of the Borough of Media shall be taken to the Council of the Borough
of Media within 30 days of the notice of determination by the Secretary.

This article shall be effective immediately and shall be applicable
to persons filing the claim in the year 1985 for a rebate of sewer rentals
paid during the fiscal year 1984.
