Parking-by-permit-only zones may by ordinance
be created from time to time as determined necessary and appropriate
by the Board of Commissioners.
No parking-by-permit-only zone shall be created
unless the Board of Commissioners determines that the following criteria
are met:
A. That the area to be designated as a parking-by-permit-only
zone is primarily residential in character and is located in close
proximity to an area that is primarily commercial in nature.
B. That street parking in the area to be designated as
a parking-by-permit-only zone is frequently unavailable to residents
due to the frequent and persistent parking of vehicles by individuals
who are not residents in the area to be so designated.
Notwithstanding the provisions of §
156-66, above, an area which experiences occasional parking overflows from scheduled events shall not be designated as a parking-by-permit-only zone.
Parking-by-permit zones shall be clearly identified
as such by signage approved by the Abington Township Traffic Safety
Officer, the Township of Abington Public Works Department, and the
Board of Commissioners.
Only vehicles bearing a permit approved by the
Abington Township Traffic Safety Officer, the Township of Abington
Public Works Department, and the Board of Commissioners (hereinafter
referred to as a permit) shall be permitted to park in an area designated
as a parking-by-permit-only zone.
Permits shall be issued by the Traffic Safety
Officer to the owners of properties abutting parking-by-permit-only
zones. A maximum of two permits shall be issued to any one property.
Any person violating any provision of this article
shall be guilty of a summary offense and, upon conviction thereof
by the local District Justice, shall be required to pay a fine of
not less than $100 nor more than $300, plus court costs.
