The office of Town Manager is hereby created pursuant to Article 3-B of the Town Law of the State of New York.
The Town Manager shall be appointed by a majority of the Town Board for an indefinite term on terms and conditions formally agreed upon by the Town Board. The Manager shall be chosen by the Town Board, solely on the basis of his or her executive and administrative qualifications, with special reference to actual experience in, and knowledge of accepted practices with respect to town government. No Town Board member shall receive such appointment during the term for which the Town Board member has been elected. The Town Manager may be a full- or part-time position at an annual salary as set by the Town Board.
The Town Board may remove the Town Manager at any time by a majority vote of its members. The Manager may be suspended at any time from his or her duties by the Town Board for any reason, or no reason whatsoever; however, during such period of suspension the Manager's salary shall be paid until such time and day as the majority of the Town Board shall terminate the Manager, at which time said salary, all benefits, and/or contractual payments shall cease as provided herein or pursuant to any contract entered into by the Town Board with said Manager.
A. 
The Town Manager shall be considered an administrative officer of the Town and may be appointed to head one or more departments by the Town Board, and he or she shall be responsible to the Town Board for the administration of the Town. The Supervisor of the Town of Niagara shall be the immediate supervisor of the day-to-day activities of the Manager, and the Manager shall report to the Town Supervisor on a daily basis.
B. 
The Manager shall have the following duties, or such other duties as directed by the Supervisor of the Town:
(1) 
Make recommendations to the Supervisor and Town Board regarding the suspension and removal of employees of the Town and the hiring of new employees.
(2) 
Assist in the preparation of budgets and financial statements.
(3) 
Prepare and submit, as directed by the Supervisor, to the Town Board at the end of each fiscal year a complete report on the finances and administrative activities of the Town for the preceding year, including recommendations for changes and cost saving measures.
(4) 
Advise the Supervisor and Town Board of the financial condition of the Town and make such recommendations as he or she deems desirable.
(5) 
Assist and coordinate in the economic development of the Town, planning and zoning and provide day-to-day support and coordination of the activities of the Town of Niagara Industrial Development Agency, the Department of Zoning and Planning, and the Department of Inspections, with respect to development within the Town.
(6) 
Attend all meetings of the Town Board and work sessions unless excused by the Supervisor, and attend such other further meetings within or without the Town as directed by the Supervisor, and otherwise represent the Supervisor when he is unable to attend Town business.
(7) 
Perform such other duties as may be directed by the Supervisor not inconsistent with the Town Law of the State of New York and this article.
No Town Board member shall individually direct or request the Town Manager to take any action with respect to the affairs of the Town, nor shall the Town Board members give any order to the Town Manager, either publicly or privately. It is the intent of this article that the Town Manager shall work as an administrative aide to the Supervisor of the Town of Niagara on a day-to-day basis. Town Board members may, however, for the purposes of inquiry only, discuss Town business with the Manager and obtain such data and reports as they may request.
This article shall take effect immediately.
If any provision of this chapter is held to be unconstitutional or otherwise invalid by any court of competent jurisdiction, the remaining provisions of the chapter shall not be invalidated.
