Chapter 152 (Roads, Bridges and Rights-of-Way) of the Code of Public Local Laws of Caroline County, (the "County Roads Ordinance"), as may be amended herein and as may hereafter be amended or replaced by the County Commissioners of Caroline County, Maryland, is hereby adopted as and for the Ridgely Roads Ordinance. A copy of the County Roads Ordinance is attached hereto and incorporated herein as if fully set forth.
A. 
Section 152-9 of the County Roads Ordinance shall be amended to read and apply as follows within the corporate limits of the Town:
(1) 
No person shall perform any road construction, as defined in § 152-2 of the County Roads Ordinance, as amended, on any town road or right-of-way, or the curbing, gutters, culverts, bridges, shoulders or ditches thereof, unless such person:
(a) 
Obtains a permit from the Director of Public Works, the application for which shall set forth, in writing, the nature and location of the proposed road construction, the extent of any proposed cuts and the estimated length of time and cost of the road construction and be accompanied by an application fee, the amount of which shall be established and amended by resolution of the Commission; and
(b) 
Pays a road construction fee, the amount of which shall be established and amended by resolution of the Commissioners and which shall be due at the time the permit application is approved and prior to the issuance of a permit; provided, however, that the Commissioners reserve the right, in their sole discretion, to also require adequate security in a form and amount acceptable to the Commissioners for any construction that, in the Director of Public Works' opinion, is anticipated to exceed the amount of the road construction fee.
Notwithstanding § 155-18 above, all references in the County Roads Ordinance to other Caroline County laws, rules, regulations or officials shall be deemed to refer to their equivalents or counterparts, as the case may be, in or of the Commissioners of Ridgely and/or the Town of Ridgely.

Whenever conflict or ambiguity arises about this article, it shall be resolved in favor of an interpretation consistent with furthering the stated scope of the County Roads Ordinance (§ 152-3 thereof) and shall, whenever reasonable, give due deference to the interpretation and/or opinion of the Ridgely Director of Public Works.

This article shall take effect upon enactment and apply hereafter to all situations not covered by any grandfathering provision of of the County Roads Ordinance.
