[Adopted 3-7-1921]
As used in this article, the following terms shall have the meanings indicated:
DISORDERLY ASSEMBLAGE
Any two or more persons gathered together and acting in a boisterous, offensive or threatening manner towards each other or others, or committing an act or acts which are a breach of the peace or which tend to create a breach of the peace.
DISORDERLY HOUSE
Any house, store or building or any part thereof which is used for gambling or is frequented by gamblers, prostitutes, vagrants or disorderly persons or in which the law is habitually violated.
HOUSE OF ILL FAME
Any house or building or any part thereof in which prostitution, lewdness or any other immoral or unlawful sexual acts are permitted.
JUDGE
Any Judge of the Municipal Court or other officer invested with jurisdiction to hear complaints of violations of the criminal laws of the state or of ordinances of the City of Hackensack, and to either hold the persons so charged for action of the grand jury or hear and determine the complaint, and to impose penalties for the violation of any of the ordinances of the City of Hackensack.
MUNICIPAL COURT
Any proceeding before a Judge, as defined above.
VAGRANT
A person without visible means of support who is idle and, though able to work for his or her maintenance, refuses to do so and lives without labor or on the charity of others.
A. 
No person shall maintain or aid, assist or abet the maintenance of a disorderly house.
B. 
No person shall maintain or aid, assist or abet the maintenance of a house of ill fame.
C. 
No person shall commit any lewd or immoral act in any house, building, public or private place.
D. 
No person shall interfere with the proceedings of any Municipal Court, or use any offensive or abusive language to any Judge while holding any Municipal Court.
E. 
No person shall interrupt or disturb any religious services or any meeting, congregation or assembly.
F. 
No person shall engage in a fight or personal encounter, or use or attempt to use physical violence toward another.
G. 
No person shall take part in or aid, abet or assist a disorderly assemblage.
H. 
No person shall solicit from house to house or in any public street, park or public place the gift of money, clothing or other thing for his own use.[1]

I. 
No person shall conduct, take part in or aid or abet in a cockfight, dogfight or any unlawful prize or boxing contest.
J. 
No person shall appear in any street or public place in a state of nudity or in a dress not belonging to his or her sex or in an indecent or lewd dress.
K. 
No person shall interfere with, deface or mutilate any fire alarm box or fire alarm system or any part thereof or any apparatus connected therewith.
L. 
No person shall knowingly give or send or cause to be given or sent a false fire alarm.
M. 
No person shall expectorate upon any sidewalk or upon the sides, walls, floors or platform of any building, car, cab, bus or other public vehicle.[2]

N. 
No person other than the person in charge of the operation of an elevator shall handle, operate or manipulate any rope, shifting rod lever or other apparatus or thing attached to or used to start or stop any elevator, unless requested by the person in charge of such elevator so to do.
O. 
No person shall forcibly interfere with any member of the Police Department or the Fire Department or any officer of the municipality in the performance of his duties, or prevent or attempt to prevent any member of the Police Department or the Fire Department or any officer of the municipality from performing his duty.
P. 
No person shall enter a store or any other business with the intent to commit an offense therein.

A. 
During a state of emergency declared by federal, state or county authorities affecting the City of Hackensack, or a state of emergency declared by the City Council, the City Manager shall be empowered to issue temporary emergency orders that shall be enforceable during the declared period of emergency.
B. 
Such emergency orders shall be enforced by the Police Department, Fire Department, City Constable and/or any other City official or employee empowered to issue complaints alleging violations of the Chapter 119 of the City Code.
C. 
Emergency orders issued by the City Manager shall be limited to those necessary to promote or enhance the general peace and good order of the community, including, but not limited to, protecting the health, safety and welfare of Hackensack residents during the period of emergency.
D. 
All emergency orders issued by the City Manager pursuant to this authority shall be reviewed and approved in writing by the City's Municipal Emergency Management Coordinator prior to taking effect. Upon such approval they shall become immediately effective and enforceable unless by the terms of an emergency order it shall become effective at some other date and time. Such orders shall remain in effect until the declared state of emergency is over or upon such terms as the emergency order provides, whichever is sooner.
E. 
All emergency orders issued by the City Manager shall be provided to the City Council in writing no later than the next City Council meeting after issuance and, as soon as practicable after issuance, shall be posted at City Hall at the location where City public notices are posted, filed in the office of the City Clerk, and published on the City's Internet web site. All emergency orders shall also be submitted for publication in the City's official newspaper(s) as soon as practicable, although they shall remain effective and enforceable during the period prior to publication.
F. 
No emergency order issued by the City Manager shall violate the United States or New Jersey constitutions or any applicable federal or state law or regulation, or contradict any order issued by the Governor of New Jersey pursuant to N.J.S.A. App. A:9-40 during a declared state of emergency. However, an emergency order may temporarily modify, expand upon, enhance or clarify existing provisions of the City Code.
G. 
Violations of an emergency order may be issued against an individual and/or a business or other corporate entity. The minimum fine for a first offense shall be $250, and for a second and subsequent offense the minimum fine shall be $500. The maximum fine for any offense shall be $2,000.
