No person shall operate or maintain a trailer court in the Borough of
Hamburg unless such person shall first:
A. Obtain a license or permit therefor from the Board of
Health of the borough if such license or permit shall be required by any ordinance
of the Board of Health of the borough;
B. File a certificate with the Borough Clerk showing the
issuance of such license by the Board of Health; and
C. Obtain a license from the Borough Clerk and pay the deposit
fees as hereinafter provided.
Licenses for the maintenance and operation of trailer courts as required by this chapter shall be issued by the Borough Clerk upon the payment to him/her of the fees herein required and the filing of a written application signed by the person seeking a license to maintain and operate a trailer court; to which application there shall be annexed a map of the trailer court showing all trailer coach spaces within the same, numbered consecutively. The application shall contain the information required by the registry, required by §
199-6 hereof as the same shall exist at the time of making application, and shall state whether the applicant is the owner of the premises for which a license is sought, and, if not, the name of the owner and the interest of the person making application in the property, whether as purchaser under contract, lessee, or otherwise. In the event the applicant is not the owner of the premises for which the license is sought, there shall be deposited with the Borough Clerk, in addition to the fees otherwise required, the sum of $1,000 to be held by the Clerk to ensure compliance with the terms of this chapter, which deposit fee shall be returned to the licensee upon expiration of permit, less such sums as may be found to be due to the borough under the terms of §
199-9.
Every person holding a license for the operation of a trailer court
shall keep and maintain a register in which shall be inscribed the true name
and address of each and every person parking a trailer coach at the trailer
court or leasing a trailer coach or trailer coach space at the court; the
license number of the trailer coach; the serial, type and license number of
each automobile, the date of arrival, date of departure; the age, name and
last permanent address of the owner of the trailer coach and automobile of
each occupant thereof; and the numbered space in the trailer court occupied
by the trailer coach. The register shall at all times be open for inspection
by any member of the Borough Police Department or by the Sanitary Inspector
of the Board of Health.
The operator of every trailer court shall cause each space authorized
for the parking of trailer coaches to be numbered consecutively.
Every person applying for a license shall pay to the Borough Clerk a deposit of $20 for every trailer coach then registered in the trailer court, or, if no trailer coaches are then registered, a deposit fee of $100. The deposit fee shall be held by the Clerk to ensure compliance with the terms of this chapter, which deposit fee shall be returned to the licensee upon expiration of the license, less such sums as may be found to be due the borough under the terms of §
199-9.
Every person obtaining a license as hereinabove provided shall pay to
the borough a fee of $3 per calendar week or any portion thereof for each
trailer coach registered in the trailer court at any time during the week.
A calendar week hereby is defined as a week commencing at 12:01 a.m. on Sunday
and ending 11:59 p.m. on the following Saturday. The fees shall be paid monthly
as hereinafter provided.
The license fees herein imposed are imposed partly to cover the cost
of regulation as herein provided, and partly for the purpose of raising revenue.
