No person, firm or corporation shall keep within the limits of this Town of Franklin in any building or on land of which he may be the owner, lessee, tenant or occupant any horses, without a permit from the Board of Health.
The permit shall expire on December 31 of the said year of issuance and shall be renewed on an annual basis thereafter as applicable upon payment of a fee as established by the Board of Health. Said permit may be revoked for just cause at any time by the Board of Health.
All horses must be suitably housed. Buildings, yards and enclosures for horses must, at all times, be kept clean and free from filth, dirt and stagnant water and in a manner satisfactory to the Board of Health.
No stable shall be located within 50 feet of any dwelling other than the dwelling of the owner, tenant, lessee or occupant nor within 50 feet of any adjoining lot line nor within 50 feet of any street, without special permission from the Board.
No manure shall be kept or stored in any manner likely to attract flies or create a health hazard and shall be removed from the premises as often as may be required by the Board of Health.
The stable shall be constructed to allow an air space equal to 1,000 cubic feet for each animal. Suitable insecticides shall be used to control flies. The ventilating, lighting and draining of the stable must be satisfactory to the Board of Health.
Prior to construction of a stable, a plan for the same shall be submitted to the Board of Health. The requirements of the Board shall be complied with before a permit shall be issued. Before construction shall begin, a permit shall be obtained from the Building Department, to whom the permit from the Board of Health shall be shown.
A stable shall not be occupied until the above requirements have been complied with and written permission in the form of a permit from the Board of Health is obtained. The Board of Health or its agents shall be permitted to inspect a stable without prior notice to determine if these regulations are being complied with.
Failure to comply with this chapter shall be punishable as provided for in MGL c. 111, § 157.
