There is hereby created in the Borough of Stone Harbor the Stone Harbor Bird Sanctuary Committee to be made up of 11 members, consisting of one member of Borough Council, one representative from the Borough Administration, one representative from Public Works, two members of the Wetlands Institute and six members from the public at large, including one docent.

Except for the representative from the Borough Administration, the Public Works representative and the member selected from Borough Council, who shall be selected annually, all remaining members shall serve three-year terms.
A. 
At the first regularly scheduled meeting of the Borough Council in January of each year, the Mayor, with the advice and consent of Borough Council, shall appoint the members of the Committee.
B. 
The members appointed from the Wetlands Institute shall be selected from a list of recommendations submitted by the governing body of the Wetlands Institute.
C. 
Private citizens, various organizations operating in the Borough, and members of Borough Council may make recommendations to the Mayor for public at large appointees.
D. 
Members of the Committee shall serve without compensation except that the Borough shall annually budget a sum of money to be used to reimburse members for Committee expenses and to be used for Borough-approved projects, all to be submitted to the Borough by voucher and be subject to the approval of Mayor and Council for payment.
A. 
The general purposes of the Stone Harbor Bird Sanctuary Committee shall be:
(1) 
To preserve, protect and foster the well-being of the sanctuary and that of the birds that nest in it.
(2) 
To maintain an environment in the sanctuary that will encourage the nesting of herons and other compatible species of birds.
(3) 
To provide for the education of visitors to the sanctuary concerning the significance of the sanctuary, its historical origin and community relationship, the species of birds in the sanctuary and their importance to our environment and the need for the preservation of both the sanctuary and its inhabitants.[1]

B. 
The purposes of the Committee shall be sought to be achieved by the Committee making recommendations to the Mayor and Council as to what to do to achieve the purposes of the Committee. Borough Council may then fund those activities which it deems to be in the best interest of the Borough of Stone Harbor.

A. 
The first meeting of the Committee each year shall be held within 14 days of the appointment of the Committee membership by the Mayor. At that meeting they shall elect a Chairman, Vice Chairman and Secretary, after which the Committee can then proceed with its regular course of business.
B. 
The Chairman shall preside at all meetings and be responsible for the conduct of the Committee and its actions.
C. 
The Vice Chairman shall serve as the Chairman in the absence of the appointed Chairman.
D. 
The Secretary shall record the minutes of each meeting and post notices to the membership of coming meetings.
E. 
The Committee shall meet up to four times a year and at other times as may be called by the Chairman or by any three members of the Committee acting together.

A. 
The Committee shall submit an annual report to the Mayor and Borough Council at the first regularly scheduled meeting of Mayor and Council held in November of each year.
B. 
The annual report shall indicate the activities of the Committee during the current year. The Financial Officer of the Borough shall provide a report of receipts and disbursements related to the sanctuary.

C. 
The annual report will be a matter of public record and available for all persons to review.
The Stone Harbor Bird Sanctuary is identified as the area bounded by 111th Street on the northerly side, by the southerly side of the rear property lines of properties located on the north side of 117th Street on the southerly side, by Second Avenue on the easterly side, and by Third Avenue (Ocean Drive) on the westerly side.
The Stone Harbor Bird Sanctuary Committee shall have no independent status apart from the status created by this article, and this Committee's existence may be terminated by Borough Council by repealing this article at any time. Any assets of the Committee remaining upon termination shall be used by Mayor and Council for the upkeep and maintenance of the Bird Sanctuary.
