It shall be unlawful to traverse and/or come upon any of the following locations within the Borough of Stone Harbor, except for Borough officers, employees and contractors while performing Borough functions for the Borough of Stone Harbor and except for persons seeking access to the public beaches who may cross the easement area, described below, at the street ends or when directly exiting from Borough-owned property:
A. 
The easement area on the ocean front located on and between the ocean bulkhead and a line drawn parallel thereto at a distance of 12 feet in a generally westerly direction.

Exception: Certain portions of this twelve-foot area are owned by contiguous property owners. Each of such owners, his, her or it's agents, servants, employees, guests and invitees, may traverse and/or come upon those areas within the easement area which are owned by such owner.

The penalties for trespassing shall be as set forth in the New Jersey statutes. A violation of this section, in combination with conduct by the offender that either causes terror and/or alarm to others, incites violence, hinders or obstructs any Borough employee in performance of its duties, is unreasonably loud and/or boisterous, offends the sensibilities of the public given the time and place of the conduct, and/or otherwise has a deleterious impact on public order, shall constitute a breach of the peace.
