A. 
As used in this chapter, the following terms shall have the meanings indicated:
PEDDLER
Includes any person, firm or corporation engaging in or desiring to engage in peddling in the City.[1]
PEDDLING
Includes selling, offering for sale or requesting orders for any goods, wares or merchandise upon any of the public streets or at a stationary public location.

SOLICITING
Includes selling, offering for sale or requesting orders for the sale of any goods, wares or merchandise upon any of the streets in the City of Greensburg or from house to house.

SOLICITOR
Includes any person, firm or corporation engaging in or desiring to engage in soliciting in the City.

In this chapter, the singular shall include the plural, and the masculine shall include the feminine and the neuter.

A. 
Before any person shall engage in peddling or soliciting in the City of Greensburg, he/she shall obtain a license from the Police Department. Upon completion of applicable forms and/or applications, he/she shall meet requirements as set forth by the Chief of Police to obtain said license and shall pay the fee as set by the City Council in Chapter 151. The Police Department is permitted to conduct background checks on applicants.
B. 
Upon payment of the applicable license fee, a separate license shall be issued to each person licensed hereunder, and every such person shall carry such license upon his person at all times while engaged in peddling or soliciting in the City of Greensburg. Persons licensed hereunder shall also carry along with such license photo identification, to be displayed upon request by a prospective customer or law enforcement officer.

Any person wishing to engage in the business of a commission and forwarding agent or a merchandise broker shall take out a permit therefor and pay a license fee.

A. 
Every person, firm, association or corporation desiring to conduct a transient wholesale and/or retail business within the City of Greensburg for the sale of goods, wares, or merchandise, including food sales, shall obtain approval from Planning and Development, and the Police Department shall issue a license for the purpose of conducting such business. The amount of the fee for the license shall be as set by City Council in Chapter 151.

B. 
Any business which is conducted within the limits of the City of Greensburg with an expected duration of less than 90 days shall be considered transient and, when appropriate, shall be required to obtain a health license in accordance with Chapter 127.

A. 
Soliciting and peddling shall only be permitted between the hours of 9:00 a.m. and 5:00 p.m., Monday through Saturday.
B. 
No peddler or solicitor shall engage or attempt to engage in the business of peddling or soliciting at any home residence, apartment complex or business that prominently displays a "No Peddlers" or "No Solicitors" sign or any other similar sign that communicates the occupants' desire to not be contacted by peddlers or solicitors.

No person licensed as a peddler or solicitor under this chapter shall use any horn, public address system, reproduced music, audio output device or any other device for announcing their presence.
Nothing in this chapter shall impose a levy or collection or license tax upon or from any manufacturer or the agent, representative or employee of any manufacturer who is a resident of the Commonwealth of Pennsylvania for soliciting orders or for selling any goods, merchandise or wares manufactured within this Commonwealth that is not or cannot legally be imposed upon or exacted or collected from any manufacturer or dealer or the agent, representative or employee of any manufacturer or dealer who is a nonresident of this Commonwealth for soliciting orders or selling goods, merchandise or wares manufactured without the Commonwealth.

Nothing in this chapter shall limit the discretionary powers of the Chief of Police, the Planning Director or their designee and/or the Health Officer to suspend or revoke a permit or license under any of the sections hereof when he deems such suspension or revocation to be necessary or desirable for the public health, safety or morals.

Any person, firm or corporation violating any of the provisions of this chapter shall, upon conviction thereof, for each offense or violation, be sentenced to pay a fine of not more than $600 or be imprisoned for a period not exceeding 90 days, or both such fine and imprisonment.
