As used in this chapter, the following terms shall have the meanings set forth below:
MOTORIZED SCOOTER
A scooter that is propelled by a small motor located on the vehicle. This definition shall expressly exclude any personal transportation devices designed specifically for and actually used by disabled persons.
SCOOTER
A vehicle that typically has two wheels with a low footboard between the wheels, is controlled by a handle or handle bar and is propelled by pushing one foot against the ground while resting the other on the footboard.
A. 
No person shall operate or ride on a scooter, or permit others to do so, in the Town of Phillipsburg unless that person is wearing a properly fitted and fastened helmet which meets the standards of the American National Institute (ANSI 290.4, bicycle helmet standard) of the Snell Memorial Foundations' 1990 Standard for Protective Headgear for Use in Bicycling.
B. 
Any person operating a scooter in the Town of Phillipsburg shall abide by all traffic control devices, restrictions and rules of the road.
C. 
No person shall operate or ride on a scooter, or permit others to do so, in the Town of Phillipsburg in:
(1) 
A reckless, careless or negligent manner which endangers the safety or property of others; or
(2) 
In any manner that creates such noise which disturbs or interferes with persons in their peaceful and quiet enjoyment.
D. 
No person shall operate or ride on a motorized scooter, or permit others to do so, in the Town of Phillipsburg.
Any person who violates any provision of this chapter shall be fined $25 for the first offense and not less than $50 nor more than $100 for each subsequent offense.
