It shall be mandatory for all persons who are owners, tenants or occupants of residential and nonresidential premises, which shall include but not be limited to retail and other commercial locations, as well as government, schools and other institutional locations within the Town of Phillipsburg to separate designated recyclable materials from all solid waste. Designated recyclable materials shall be deposited separate and apart from other solid waste generated by the owners, tenants, or occupants of such premises and shall be placed separately at the curb in a manner and on such days/times so designated by the Town of Phillipsburg.
The following is a list of materials accepted:
Paper – dry and clean; loose (not in plastic bags)
Newspaper and inserts
Magazines and catalogs
Junk mail, envelopes, file folders
Office white, colored and computer paper (staples, paper clips ok)
Corrugated cardboard boxes
Cereal and gift boxes, etc., that tear brown or grey (remove liners)
Paper bags and phone books
Wrapping paper (remove metallic paper, bows, etc.)
Containers – empty and clean; loose (not in plastic bags)
Aluminum cans (beer and soda)
Aluminum foil and foil plates, etc.
Glass bottles and jars (food and drink only)
Plastic bottles, jars, tubs and buckets (such as soda, water, milk, juice, liquor, shampoo, detergent, condiments, salad dressing, yogurt, margarine, pet food, etc.)
Metal food cans (tin/steel); metal lids
Metal pots and pans
Materials do not have to be separated.
All recyclable containers shall be placed, prior to collection, curbside, or other designated location for collection. The owner or occupant of premises shall not place recyclable containers to the curb prior to 6:00 p.m. the evening prior to scheduled collection. The owner or occupant of the premises shall keep all receptacles clean and in safe handling condition. After collection, containers must be removed from the curbside or other designated collection site by the end of the day of collection.
From the time of placement of recyclable materials at the curb for collection by the Town of Phillipsburg, said recyclable materials shall be and become the property of the Town of Phillipsburg or its authorized agent. It shall be a violation of this article for any person unauthorized by the Town of Phillipsburg to pick up or collect, tamper with, disturb or vandalize any such recyclable materials. Any such collection, tampering with, disturbance or vandalizing in violation hereof from one or more premises shall constitute a separate and distinct offense punishable as herein provided.
Anything herein to the contrary notwithstanding, any person who is an owner, lessee or occupant who may wrap solid waste in used newspapers shall discard same with regular solid waste.
Anything herein to the contrary notwithstanding, any person who is an owner, lessee or occupant may donate or sell used recyclable materials to any person, partnership or corporation, whether operating for profit or not for profit. Said person, partnership or corporation may not, however, under any circumstances, pick up said recyclable materials from curbside in the Town of Phillipsburg.
The Department of Municipal Services consisting of Public Works Inspections and the Department of Police are hereby authorized to enforce this article.
Any person who shall violate any of the provisions or regulations of this article shall, for each and every violation, be punished as provided in Chapter 1, General Provisions, Article II, General Penalty, and each day during which any violation continues shall constitute a separate offense.
