As used in this chapter, the following terms shall have the meanings indicated:
LIBRARY
The Free Public Library of Rutherford, New Jersey, as established by the Borough of Rutherford in accordance with N.J.S.A. 40:54-1 et seq.
No person shall detain or fail to return any book, periodical, pamphlet, artistic reproduction, phonograph recording, audiovisual material or any other article borrowed from the library after 30 days have elapsed from the date of posting by certified mail, return receipt requested, of a notice demanding return thereof, addressed to said person at the last address furnished.
No person shall cut, tear, deface, disfigure, damage or destroy any book, periodical, pamphlet, artistic reproduction, phonograph recording, audiovisual material or other article, or any part thereof, which is borrowed from, owned by or is in the custody of such library.
No person, with intent to defraud, shall register or furnish a false name or address or use any card other than the one issued to said person for the purpose of borrowing any book, periodical, pamphlet, phonograph recording, audiovisual material or other articles from said library.
The Library Board of Trustees shall adopt and post in a conspicuous place in the Free Public Library Building rules, regulations and procedures governing the borrowing of books, periodicals, pamphlets or any other item or article which may be available to the public for such borrowing.
No person shall remove any book, periodical, pamphlet, artistic reproduction, phonograph recording, audiovisual material or any other item or article from the Free Public Library Building without complying with the rules, regulations and procedures of the library for borrowing such items or articles.
The provisions of this chapter shall be enforced by the Director of the library or such other person as may, from time to time, be designated by the Board of Trustees of the library. The Director, or his designated agent, is authorized to file a complaint in the Municipal Court of Rutherford for any violations. In the event of a complaint for overdue material, said Director shall first, by certified letter, return receipt requested, inform the person that the book or material is overdue and that he or she is subject to prosecution pursuant to this chapter, 30 days prior to filing complaint.
Any person who violates or refuses to comply with the provisions of this chapter shall, upon conviction thereof, be subject to a fine not to exceed $50 or twice the cost of the book, whichever is greater, and a penalty of not more than $100 for the second and each succeeding offense.
This chapter shall take effect after final passage and publication according to law.
