The provisions of Article 19-A of the General Municipal Law are hereby applicable to the establishment of Business Improvement Districts in the City of Canandaigua.
This article shall take effect immediately upon filing with the Secretary of State; provided, however, that such article is subject to a permissive referendum, and the City Clerk/Treasurer shall forthwith proceed to notice such fact and conduct such referendum if required by petition.

The Downtown Business Improvement District (BID) shall be and is hereby established in the City of Canandaigua, the City Council having found that the establishment of the district is in the public interest, that all notice, mailing and hearing requirements have been complied with, that all properties within the district will benefit from the establishment and that all property benefitted is included in the boundaries of the district. The boundaries of said districts are contained in the district plan adopted by this body on April 30, 1992, by Resolution No. 52 and as set forth below:
A. 
All properties abutting: the east and west sides of South Main Street commencing at the railroad tracks and extending to Antis Street on the west side and Saltonstall Street on the east side; the north and south sides of Chapin Street commencing at South Main Street and extending to and including the Labelon property, on the north side and the Rochester Telephone Company property on the south side; the north side of Coy Street commencing at South Main Street and extending to and including the Canandaigua National Bank parking lot and the south side of Coy Street for its entire length; the east side of Bemis Street between Coy Street and Coach Street; the north side of Coach Street for its entire length and the south side of Coach Street commencing at South Main Street and extending to and including the property at 39 Coach Street; the north and south sides of Bristol Street commencing at South Main Street and extending to and including the City parking lot on the north side and the property at 29 Bristol Street on the south side; the City parking lot which abuts Antis Street and all properties abutting the north side of that parking lot; the north and south sides of Niagara Street commencing at South Main Street and extending to and including the Murphy's Tire property on the north side and extending to Lafayette Avenue on the south side; the west side of Lafayette Avenue for its entire length and Lafayette Center Plaza on the east side; the north and south sides of Phoenix Street commencing at South Main Street and extending to Lafayette Avenue; and the east and west sides of Mill Street.
The construction improvements and provision of services within the district shall be pursuant to such district plan of the Downtown Business Improvement District. All said services shall be in addition to, and not a substitution for, required municipal services provided by the City of Canandaigua on a City-wide basis.
A. 
To the extent not otherwise explicitly provided herein, the provisions set forth in Article 19-A of the General Municipal Law shall govern the operation of the BID and the District Management Association in the City.
B. 
Insofar as the provisions of this article are inconsistent with the provisions of any other local law or act, the provisions of this article shall be controlling.
Any amendments to the BID or to the BID Plan shall be made in accordance with the provisions set forth in § 980-i of Article 19-A of the General Municipal Law.
This article shall become effective upon compliance with the requirements set forth in § 980-g of Article 19-A of the General Municipal Law, and upon compliance with all other requirements of law.
