[Adopted 12-4-1996 by Ord. No. 96-03]
Except when necessary to avoid conflict with other traffic or to protect the safety of any person or vehicle, or in compliance with law or the direction of a police officer or other authorized person, or official traffic control device, the following prohibitions shall be in effect:
A. 
Stopping, standing or parking of a vehicle is expressly prohibited under the following circumstances:
(1) 
On the roadway side of any vehicle stopped or parked at the edge or curb of the street.
(2) 
On any sidewalk.
(3) 
Within any intersection.
(4) 
On any crosswalk.
(5) 
Between a safety zone and the adjacent curb within 30 feet of points on the curb immediately opposite the ends of a safety zone.
(6) 
Alongside or opposite any street excavation or obstruction which obstructs traffic.
(7) 
Upon any bridge or other elevated structure.
(8) 
On public or private property which is expressly reserved for handicapped persons or disabled veterans, when said property has been posted in accordance with the regulations of the Pennsylvania Department of Transportation.
(9) 
Fire lane no parking, standing or stopping zones:
(a) 
The Township Fire Marshal shall establish no parking, standing or stopping zones in those areas where parked vehicles may impede the progress, access, ingress and egress of fire equipment, ambulances, or other emergency vehicles and equipment from residential or commercial buildings.
(b) 
The Township Fire Marshal is further directed to post the aforementioned areas with signs reading "No Parking By Order of the Fire Marshal."
(c) 
After said areas are posted, the Fire Marshal shall maintain a complete listing physically describing such areas posted, which areas shall immediately thereafter be ordained as no parking, standing or stopping areas.
(d) 
Thereafter, any vehicle found in violation of any fire lane removed from said area. The registered owner or operator of said vehicle shall be promptly notified of the fact of the removal and the place to which said vehicle has been removed, where he or she may obtain same upon payment of all towing and storage charges.
(10) 
At any place where official signs prohibit same.
B. 
Standing and parking of vehicles is expressly prohibited under the following circumstances:
(1) 
In front of a public or private driveway.
(2) 
Within 15 feet of any fire hydrant.
(3) 
Within 20 feet of a crosswalk at an intersection.
(4) 
Within 30 feet of any flashing signal, stop sign, yield sign or traffic control signal located at the side of a roadway.
(5) 
Within 20 feet of the driveway entrance to any fire or ambulance station, or when properly posted, on the side of the street opposite to any fire or ambulance station within 75 feet of the entrance.
(6) 
Any place where official signs prohibit same.
C. 
Parking a vehicle is expressly prohibited under the following circumstances:
(1) 
Within 50 feet of the nearest rail of a railroad crossing.
(2) 
Any place where official signs prohibit parking on the opposite side of the street/roadway.[1]

D. 
Exceptions. The following are exceptions to the restrictions set forth in this section:
(1) 
The Chief of Police of the East Brandywine Township Police Department, or his or her designee, may authorize parking in any area which would otherwise be prohibited.
A. 
No person shall park or leave unattended a vehicle on private property without the consent of the owner or other person in control of the property; except in the case of an emergency or disablement of the vehicle, in which case the operator shall arrange for the removal of the vehicle as soon as possible, and in no event later than two hours.
B. 
The provisions of Subsection A of this section shall not apply to private parking lots unless such lots are posted to notify the public of any parking restrictions, in which case the operator of a vehicle shall not violate said posted restrictions. For the purpose of this section, "private parking lot" shall mean a parking area open to the public and used for parking with or without charge
A. 
No commercial vehicle, including but not limited to trucks/tandem axle vehicles (in excess of one-ton capacity), tractor-trailers, tractors, or other commercial construction or cargo-moving vehicles or equipment shall be parked upon any highway or street with the Township of East Brandywine. Furthermore, no commercial equipment as described in this subsection shall be parked or stored upon any highway or street in the Township after completion of the working day.
B. 
Exceptions. The following are exceptions to the restrictions set forth in Subsection A of this section:
(1) 
The loading and unloading of goods or merchandise, or the rendering of services during normal business hours, is hereby permitted, but restricted to such length of time as is absolutely necessary for said purpose, provided that such vehicle does not substantially impede traffic flow or impair the safety of persons or property. No person shall load or unload any vehicle from any place upon any street or road in the Township where parking is prohibited, unless by the express written permission of the Chief of the East Brandywine Township Police Department, or his or her designee. The Chief of Police may, at his or her discretion, block any portion of the street or road affected by such loading or unloading.
(2) 
Vehicles being used for the purpose of road construction shall be permitted to park, stand or stop or any highway or street within the Township of East Brandywine only when construction is in progress upon said street or highway. The contractor shall provide for appropriate traffic control.
A. 
Following the effective date of this article, it shall be unlawful to park, or allow to be parked, any motor vehicle or other vehicle, or portion thereof, on any street or road which is part of the Township road system, two hours after the start of any continuous snowfall, and until the snow has been completely plowed for the full width of the cartway.
B. 
Any member of the East Brandywine Police Department, or other employee of the Township of East Brandywine who is engaged in snow-removal operations, is hereby authorized to remove, or have removed, any vehicle abandoned or parked upon any public street, highway, or roadway which is part of the Township road system, which is in violation of the terms and provisions of this section, and to take, or have taken, any such vehicles to an appropriate secure parking or storage facility. The registered owner of any such vehicle shall be promptly notified of the fact of the removal, and the place to which said vehicle has been removed, where he or she may obtain same upon payment of any and all towing and storage charges.
C. 
Exceptions. The following are exceptions to the restrictions set forth in this section:
(1) 
The Chief of Police of the East Brandywine Township Police Department, or his or her designee, may authorize parking in any area which would otherwise be prohibited.
A. 
Any person violating any provision of §§ 245-5 and 245-6 of this article, with the exception of § 245-5A(8) (handicapped parking) or § 245-5A(9) (parking in a fire lane), shall be guilty of a civil offense and, upon conviction before a Magisterial District Judge within the magisterial district of which the Township of East Brandywine is a part, shall be fined up to $15 plus costs of prosecution.
B. 
Any person violating § 245-5A(8) (handicapped parking) or § 245-5A(9) (parking in a fire lane) shall be guilty of a civil offense and, upon conviction before a Magisterial District Judge within the magisterial district of which the Township of East Brandywine is a part, shall be fined $50 plus costs of prosecution.
C. 
Any person violating any provision of §§ 245-7 and 245-8 of this article shall be guilty of a civil offense and, upon conviction before a Magisterial District Judge within the magisterial district of which the Township of East Brandywine is a part, shall be fined not less than $25 nor more than $300, plus costs of prosecution.
D. 
Reduced penalty.
(1) 
In all cases where a police officer or parking enforcement agent of East Brandywine Township first gives notice to a person of any violation of this article, either by personal service to the offending operator or by affixing to the vehicle in violation a ticket, noting the date, time and location, the nature of the offense charged, and the license registration of the vehicle in violation, prosecution shall not be instituted for five days thereafter. If during said five-day period, the offending operator voluntarily appears during regular business hours at the East Brandywine Police Administration Office, voluntarily enters a plea of guilty, and pays a fine of $10 for violating a provision of § 245-5 or 245-6, with the exception of § 245-5A(8) (handicapped parking) and § 245-5A(9) (parking in a fire lane), or a fine of $20 for violating a provision of § 245-7 or 245-8, no prosecution for said offense shall be brought. In the alternative, said offender may forward the appropriate fine to the Police Administration Office by regular mail, and no prosecution for the offense shall thereafter be brought so long as the envelope is postmarked within five days of the violation.
(2) 
Violations of § 245-5A(8) (handicapped parking) and § 245-5A(9) (parking in a fire lane) shall not be subject to any reduced penalty.

The provisions of this article are severable. If any section, sentence, clause or phrase of this article is determined to be illegal, invalid or unconstitutional by any court of competent jurisdiction, such decision shall not affect or impair the remaining sections, sentences, clauses or phrases of this article. It is hereby declared as the intent of the Board of Supervisors that this article would have been adopted had such invalid or unconstitutional section, clause, sentence or phrase not been included herein. Furthermore, it is the intent of this article to be supplementary to and not contrary to any laws of the Commonwealth of Pennsylvania or regulations of any of its agencies.
