This article shall be known and may be cited as the "Ordinance Prohibiting the Possession and Consumption of Alcoholic Beverages in Public Places."
As used in this article, the following terms shall have the meanings indicated:
INTENT TO CONSUME
Drinking from the container, with alcohol on the breath of the possessor and/or any circumstances evidencing an intent to ultimately consume on any public lands.

No person shall have in his possession with intent to consume or carry or transport any open bottle or open container containing liquor, wine, beer, or other alcoholic beverage while such person is in or upon any public sidewalk, street, highway, or parking lot without the permission of the Common Council. No person shall have in his possession with intent to consume or carry or transport any open bottle or open container containing liquor, wine, beer, or other alcoholic beverage while such person is in the public parks known as "West Park Place," "East Park Place," "Kurt Beyer Municipal Pool and Park" and "Rotary Park."

No person shall drink or otherwise consume liquor, wine, beer, or other alcoholic beverage while such person is in or upon any public sidewalk, street, highway, or parking lot without the permission of the Common Council. No person shall drink or otherwise consume liquor, wine, beer, or other alcoholic beverage while such person is in the public parks known as "West Park Place," "East Park Place," "Kurt Beyer Municipal Pool and Park" and "Rotary Park."
The provisions of this article shall not apply to any special event designated by resolution duly adopted by the Common Council specific as to the date or dates, boundaries and hours thereof. Nothing herein contained shall be construed so as to prohibit the Common Council from placing any other or further restrictions with regard to any exemption granted for any special event.
Any person in violation of this article shall be subject to a fine of not more than $250 or imprisonment for not more than 15 days, or both.
