This chapter shall be known and may be cited as the "Loyalsock Township Merchandise Display Ordinance."
This chapter is enacted for the promotion of the health, safety, welfare and general good order of properties within the Township's Commercial and Industrial Districts.
As used in this chapter, the following terms shall have the meanings indicated:
DISPLAY MATERIALS
Merchandise for sale, including samples of such goods which may not work or function or be for display only and are located in the outdoor display area.
MERCHANDISE
Goods, commodities, materials and any other item for sale, lease or purchase.
OUTDOOR DISPLAY AREA
The area of land on a lot or combination of lots located between the street right-of-way line and the building or buildings on the lot or lots.
A. 
Storage. Only merchandise that is normally kept outside or periodically kept outside may be stored in the outdoor display areas of the commercial and industrial zoned properties of Loyalsock Township. Such items allowed to be displayed outdoors, but not necessarily limited to, are as follows:
(1) 
Vehicles such as cars, trucks, construction equipment, lawn mowers and other similar items.
(2) 
Lawn furniture, lawn ornaments, picnic tables, flowers and other plant items.
(3) 
All merchandise must be displayed in a neat and orderly fashion free from any unstable piles or stacking.
(4) 
The following items are not allowed to be displayed in the outdoor display area:
(a) 
Indoor furniture, home appliances, bedding, bedding materials, washers, dryers, freezers, vacuum cleaners, sewing machines and small household appliances.
(b) 
Any item or items that can be damaged by weathering over a reasonably short period of time.
(5) 
The Loyalsock Township Board of Supervisors retains the right to determine if any item is an appropriate outdoor display item.
B. 
Exemptions. This chapter is not to prohibit the operation of a yard sale or garage sale for any property in the Commercial or Industrial District that is occupied by a single-family dwelling or duplex which is a nonconforming use in such districts. Such sales must be operated as permitted by § 215-12G(4) of the Zoning Ordinance.
All display materials in the Commercial and Industrial Zoning Districts of Loyalsock Township must be located in the outdoor display area. Said items must be placed:
A. 
A minimum of 15 feet from the face of the curb or the exterior edge of the street pavement.
B. 
In a location that does not interfere with sight distance at any street or driveway intersection.
C. 
All display materials must be on private property and not on any public right-of-way nor block any public sidewalk.
This chapter shall be enforced by action brought before a District Justice in the same manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure. Any person who violates or permits the violation of this chapter shall, upon conviction in a summary proceeding, be punished by a fine of not less than $100 nor more than $1,000 or by imprisonment for a term not exceeding 90 days. Each day or portion thereof that such violation continues or is permitted to continue shall constitute a separate offense. Each section of this chapter that is violated shall also constitute a separate offense.
