Whereas the Village Board of Trustees in mindful of the continued need to protect the waters of Greenwood Lake from the harmful effects of excess phosphates and nutrients, and whereas the Village Board of Trustees has become aware of the role of garden fertilizers in contributing to the increase of excess phosphates and nutrients in the waters of Greenwood Lake, it is believed that regulation of the use of fertilizers will be in the interest of the health, safety, and general welfare of the community.
As used in this article, the following terms shall have the meanings indicated:
FERTILIZER
Any commercially or privately prepared product, which is intended to increase the nutrient content of soil or water.
It shall be unlawful, within the boundaries of the Village of Greenwood Lake, Inc., to possess, transport, sell or release into the environment any fertilizer which contains phosphorus.
It shall be unlawful for the owner, user or occupier of any parcel of property within the boundaries of the Village of Greenwood Lake, Inc. to knowingly, or negligently by virtue of insufficient control, allow the release into the environment of any fertilizer which contains phosphorus.
The recognized enumerated exceptions are as follows:
A. 
The provisions of this article shall not apply to any organic manure or compost, which has not been adulterated with fertilizer or other additives.
Any person who violates the provisions set forth in this article shall be subject to a fine of not more than $250 or imprisonment not to exceed 15 days, or both.
