A. 
The Village Board finds that the activity of fishing from the shoreline of the body of water commonly known as "Greenwood Lake," or accessing the waters, or frozen waters, of Greenwood Lake, in order to engage in the activity of fishing, constitutes an activity which impacts upon the public health, safety and general welfare of the people of the Village. Unrestricted fishing may have negative effects on quality of life enjoyed by the residents of the Village of Greenwood Lake, Inc. This chapter is enacted pursuant to Municipal Home Rule Law § 10. The purpose of this chapter is to establish regulations requiring permits for nonresidents seeking to engage in fishing in order to protect the public health, safety, and general welfare of the people and resources of the Village of Greenwood Lake.
B. 
The following shall be exempt from the requirements for a permit as set forth in this chapter:
(1) 
Residents of the Village of Greenwood Lake, Inc.;
(2) 
Bona fide guests of residents of the Village of Greenwood Lake, Inc., subject to written confirmation, the requirement for which may be set by the Board of Trustees of the Village of Greenwood Lake;
(3) 
Residents of the Town of Warwick;
(4) 
Lessees of any properly permitted long-term rental property located within the Village of Greenwood, Inc., during the time of their leasehold;
(5) 
Registered guests at a legally permitted hotel, motel, bed-and-breakfast or legal short-term rental property located within the Village of Greenwood, Inc., during the time of their rental; and
(6) 
Those engaged in full- or part-time employment within the Village of Greenwood, Inc.
A. 
This chapter adopts for use in this chapter all deinitions otherwise set forth in the Code of the Village of Greenwood Lake, Inc.
B. 
"Fishing," for the purposes of this chapter, is any activity which requires a New York State Department of Environmental Conservation fishing permit.
In addition to any requirement set forth by the New York State Department of Environmental Conservation fishing permit, no person may engage in fishing within 10 feet of the shoreline of Greenwood Lake, within the Village of Greenwood Lake, Inc., or access the waters, or frozen waters, of Greenwood Lake, from the shoreline of Greenwood Lake, within the Village of Greenwood Lake, Inc., in order to engage in fishing without a fishing permit properly issued by the Village of Greenwood Lake, Inc.:
A. 
Application for a Village fishing permit must be made by form issued by the Clerk of the Village of Greenwood Lake.
B. 
Application for a Village fishing permit shall require payment of a fee as set by the Board of Trustees of the Village of Greenwood Lake.
C. 
Application for a Village fishing permit must be made in person by the applicant.
D. 
A Village fishing permit shall only be valid for one calendar day.
E. 
A Village fishing permit shall only be valid on the calendar day on which it is issued.
F. 
A Village fishing permit may not be transferred or assigned.
G. 
A previous conviction for a violation of the provisions of this chapter shall be grounds for denial of an application for a Village fishing permit.
Violations of this chapter will constitute a municipal infraction and will be subject to all applicable penalties, including a fine set by the by the Board of Trustees of the Village of Greenwood Lake.
