Excepted from this chapter and exempted from its requirements
are:
A. Vehicles stored in duly licensed and operating junkyards.
B. Vehicles kept and stored by duly licensed and operating vehicle repair
shops and garages, upon the premises where said business is conducted
and which are currently being repaired for the purpose of placing
the same back into legal operation upon the public highways.
C. Any vehicle owned by a person currently on active duty in any of
the armed forces of the United States or the State of New York, provided
that said vehicle is kept and stored on property owned by said person's
spouse or family, and provided that such vehicle is in operable condition.
D. Any farm vehicle being actively used in farming operations, provided
that:
(1) The vehicle is being used on private property and is being held for
continuing operation on private property and is not being held primarily
for nonoperating purposes; and
(2) The vehicle, if not in a condition for legal operation on public
highways, is in a condition so that it can be operated for farming
purposes and so that such operation on private property will not be
unduly dangerous to the operator, passengers or others; and
(3) The vehicle is in such condition that there is no sharp metal, broken
glass or other condition which would endanger children who might be
attracted to play around the vehicle.
